    UPDATE: Barnsley Football Club incident

    Officers investigating an incident at Barnsley Football Club on Saturday 13 April 2019 have arrested a man on suspicion of racially aggravated public order offence and racially aggravated assault.

    The man attended at a police station and was arrested today, Wednesday 17 April. He remains in police custody for questioning.

    We would ask members of the media and the public to refrain from speculation in relation to this incident as it could potentially harm the investigation.

    Enquiries into the incident are ongoing.

    I personally have no comment to make on that story and will refrain from speculation, regardless of what others are talking abart on facebook. You have to say that if he/she is found guilty and has committed repeated thuggish acts in the past then the pattern of behaviour suggests a tragic unteachability

    Not speculating about who did or didn't do what to whom.or whether something racist was uttered prior to or after any alleged assault but one thing I would say is-

    If an accused is someone with celebrity status whose past misdemeanours and reputation are public knowledge, it stands to reason that the Police and the CPS will want an absolutely watertight case before proceeding othewise the defence might argue the case is already prejudiced against and their client .
    Normally (or at least that is how I remember it from a long time ago when on jury service) previous convictions are not mentioned in trials until a verdict is reached and only then are they considered by a judge in relation to sentencing.

    It is one of the reasons I hate the gutter press for making stuff up and then people on social media regurgitating fake news. It could lead to the CPS deciding not to prosecute if they feel that the evidence may be outweighed by that fake news affecting jury impartiality.

    Hopefully, if the arrested person in question IS the one we suspect it may be, then let's hope that won't happen and the perpetrator gets his just desserts.

    Be surprised if the case would need a jury trial. Wouldn't Magistrates deal with assault/ABH whatever?

    IT could be argued it is GBH (albeit the lesser of the two types of GBH) rather than ABH based on the table below and given the severity of the victim's injuries (teeth damaged, bloodied and broken skin). My understanding is that these cases can be heard in either Magistrate or Crown Court. Interesting few weeks ahead.
