Its not got to court yet! But its 4 months since the offense to him being charged by the CPS but it looks like it took the police a couple of months to get the evidence together
I would guess the problem is the video. Stokes (allegedly) was sticking up for 2 gay lads who were being verbally abused, and rightly so if this was the case. But it would appear in the video that Stokes is the only one doing any punching, then continues punching with little or no threat to himself. I think the evidence of what came before will be key to establishing any mitigating circumstance.
If it stays at the magistrates then a softer potential sentence if he were found guilty is likely. If it is kicked up to crown court then we will know they are after a much heftier one. Eviedence to be heard though he may come out of it in a better light time will tell. Don't understand why the ECB said they would have a meeting to decide his selection status now. They banned him from playing while he was under investigation so now he has been charged I can't see that stance altering.
Lucky boy IMHO, the lad ended up with fractured eye socket - "affray" is like a catch all I guess for "a bunch of people fighting" unlikely to get the sentence he would have got for ABH.
As soon as the other bloke in the video said "you win", which he does if you listen to it carefully, Stokes had zero excuse for hitting him.
I guess he will get off with 6 months suspended and a community sentence. If the guy he was defending was a relation or friend you could make a better job of justifying his behaviour. But beating the crap out of someone you dont know for being homophobic is the reaction of someone who ultimately had a few to drink and cant control themselves.
Yep i expect something similar. Would people expect him to get a lengthy suspension from playing cricket for England, who he is contracted to? He's already been given permission to sign up for the IPl which i think starts in April.
If I was convicted of such an offence, I'd most likely be dismissed by my employers. Not saying that's right or wrong just stating my expectation.
IF he gets a suspended sentence/fine I bet the ECB will take his time already suspended from playing for England as his punishment.
Well i'd certainly be dismissed. He's got a bit of history though has Ben. He's previously been sent home from tours as a consequence of his behaviours and there's the embarrassing video of him mimicking Katy Prices' son.
If my employers (NHS) had seen the video then probably yes: one can't take chances when working with vulnerable people. We've recently had someone suspended for the use of threatening words and aggression towards a peer on a night out (no criminal charges brought either).
I totally understand that in certain areas of employment but not all .To take away his livelihood because of an alleged offence was wrong in my opinion , once he was charged then fair enough but not before . The ECB were a bit hasty in their decision to suspend him pending the charge from the CPS who themselves haven't exactly been in a rush with the whole saga .
