    I'm pretty sure justice will be done. Fine & suspended sentence. I think the gay couple story sounds a bit of a cover from all the evidence that is in the public domain. If you worked for many companies and ended up doing this you'd lose your job. (I know a few that got sacked from Yorkshire Bank in the 80's for getting involved in football violence).

    Will be down to the selectors to deal with that one. Probably a suspension I think.

    I'm not suggesting he attempted GBH.

    I'm saying he actually attempted it. Or was reckless as to whether GBH was caused, which amounts to the same thing.

    "Really serious bodily harm" can quite easily involve whacking someone like he did. If the bloke he hit ended up banging his head on the ground as a result of an assault like that, he could have died. It's happened before. Then that's murder.

    The fact that he's charged with something that doesn't fit the video footage is a matter for the prosecution.

    But it doesn't change what everyone can see for themselves.

    Sometimes I think there’s only me on here that’s done things like hitting someone with a spade.
    To say we live in Barnsley there’s a lot on here that have led very sheltered lives.
    Must be an age thing.

    Having watched that video it looks more like they're just messing about with each other. I didn't look from their body language as though they were offended by anything being said.

    Depends on his intent. Even if his intent was to cause GBH (which is what I've been rabbitting on about) rather than death, it's still murder.

    You have got no chance on proving murder with intent when someone punches another which causes them to hit the ground and ultimately be killed.

    You can't prove beyond reasonable doubt that the intent was there to kill someone. So it would be manslaughter. The way you phrased it indicates that could've happened... which suggests the intention to kill was never there.

    He didn’t intend owt of the sort.
    He’d had a drink and as he’s 20 plus years old he has a gallon of testosterone pumping through his veins so he thought instead of getting a kebab I’ll give someone a good slapping.

    We’ve all been there.
    And as we get older - we think - how did yer manage to not get killed or at least spend much of yer time in prison.

    I've been hit with spades: two spades to be precise held by 2 bouncers about 2 weeks after the magnet re-opened as Dollys. Broken arm and 60 odd stitches all over with some thorough bruising. They were from leeds and had been calling me a barnsley ****** whilst i was playing the bandit.
    I'm not shy.

    The intent for murder is the intention to kill or cause grievous bodily harm.

    Now I'm sure that Stokesy wasn't contemplating anything other than how easy it would be to spark somebody out.

    The point however remains.

    Well you were insinuating in your original statement that if he'd have banged his head then it couldve been murder. I've merely pointed out it wouldn't have been as there is no clear intent.

    I have yet to see someone done for murder due to the circumstances you claim above. They can't prove it so they always go for manslaughter. Someone i knew got killed by a punch last year. Its in court this week. The defendant is facing manslaughter charges, not murder.
