Exactly the point I was making all along. Solely looking at the cctv he wouldn’t have been charged with affray, but assault, possibly even abh. The fact he wasn’t suggested strongly there was much more to it and plenty of other evidence not in the public domain. Affray is a group fight. The judge directed the jury to find one of the group not guilty last week. If one of the group isn’t guilty the rest of the group always appeared to be unlikely to be convicted of it to me. We shouldn’t draw conclusions from one piece of evidence when the verdict given, as well as the charges made in the first place, prove that there was much more to it. Both remaining defendants were found not guilty unanimously by the jury who didn’t appear to take long to make the decision. I find that more telling than a single headline grabbing video.
Gobsmacked. Walk towards someone to spark them, claim self defence and get found not guilty (plus many other nasty things that came out during the case that show his persona and character in a terrible light). Cheat at sport by tampering with a ball and get a 12 month ban.
Delighted with the verdict and not surprised at all despite a strong prosecution case. Straight back into the team for me and I pray the ECB don’t bring disciplinary proceedings. Don’t forget they stopped him playing even before charge, meaning that he missed the Ashes. Punishment enough in my book. It was someting and nothing in the end, drunken nonsense and he’ll have learned a difficult lesson having gone through what he has. I’d be very surprised if there was a repeat.
The court have had the benefit of seeing all the video evidence, including the full timeline of what happened.
And I was talking about those who were there who did not give evidence. Anyway, from a legal point of view, he probably shouldn't have been done for affray. Which does not detract too much from what an odious dangerously violent cash-flashing mate-blaming smartarse he comes across as (to me).
