    It's impossible in law for it to have been anything other than advisory. The sovereignty of parliament is one of the pillars of constitutional law and that is amplified by the often-quoted maxim: parliament can not bind it's successors. Parliament would always retain the right to repeal any law it passed anyway. That's one of the fallacies about the argument that we gave up our sovereignty by joining/remaining in the EU. We could legislate to leave at any time - as we have done.

    You've missed the point. It doesn't matter whether anyone 'pointed it out' or not. It was an advisory referendum - that was on the record in Hansard; had it been different, with the records showing the result would be legally binding, then it would since have been thrown out due to the financial irregularities of the Leave campaign. That's not an opinion, just the facts.

    In reality Marlon, the vast bulk of MP's vote the way the whip instructs them to.

    I disagree Micky...neither you nor I read Hansard, but we all listen to Cameron Corbyn Clegg Lucas Cable Umunna Osborne Starmer ...almost to a man and woman they warned us it was binding.

    MPs vote for their party and/or their own self-interest. That rule applies whatever colour they wear.

    I remember you saying it after the event certainly, if you say you said it prior to the referendum then I accept that JD...I doubt many, if any others did, or that it was a widely shared opinion.

    If that’s the case why are MPs not doing that now?
    Granted in most cases the whip reminds them of the Manifestos on which they stood but in cases where an MP does not believe in the policy as in Brexit they vote with their heart and their have been many other instances .
    If it was as you say why are we having all this controversy?

    But in the political and law making fraternity it would have been well known and they are the one that matter.

    I actually did used to read it - it was part of my job!! But not in 2016, I'll give you that. It was only ever as binding as the protagonists wanted it to be. Like the pro footballer who commits his long-term future to a club....kisses the badge, the lot, then fecks off to a rival on a whim.

    Since the vote, which was my reference to Brexit, which as I explained previous I assumed(wrongly) as the post was about Brexit etc etc

    no need to be surprised, every leading politician told us that it was a once in a lifetime vote,no turning back,out means out etc etc, it could not have been more clearer and i cannot recall any of them saying it was advisory and not legally binding.

    maybe in the depths of parliamentary legislation there will be content about referendums not being legally binding but at no point during the run up to the vote do i recall any leading figures saying so, whether that be from the leave or the remain side.

    It can't be legally binding for the reasons I set out above. But that's all a red herring. It won't be enacted or invalidated on those grounds alone - so it's a political, not a legal issue.

    I think that the Bank of England converting billions of the treasuries foreign currency reserves into Euros is an indication that they are expecting the pound to dive and need propping up in the immediate aftermath of no deal plummet , there’s some articles today suggesting another Black Wednesday, possibly worse consequences for interest rates

    Hard to say . I think we are on the brink of a global slowdown anyway with Europe particularly exposed . Germany's back in negative territory with exports falling and other Eurozone countries unable to take up the slack due to monetary policy post 2008 . In or out of the EU the next crash was/ will hurt like hell after years of cheap money being flooded into major economies . If people can't afford to pay their debts with Interest rates at near zero then God help us .
