Under Article 75 - have we a legal right of a refund for a season ticket ?

    Its 10:12 on Friday 9th October 2020.
    If things remain the same as they are now at Barnsley Football Club - have supporters the legal right to claim money back from their season tickets?

    Clearly we can watch the games - although under the circumstances of Covid there are restrictions on that - but has the supporters been sold (told) something in how the club is going to progress (ie CEO saying the 1st team will be strengthened with 3 or 4 more players) that at this point in time has been a false claim?

    It's a myth our owners are billionaires so anyone who'd ask for a refund especially when they knew the situation when purchasing one, would be putting the future of our club in jeopardy.

    The problem the club has is if by the start of next season it's not back to normal as in packed stadiums with away fans then season pass sales will be extremely low as most fans won't put up with another season without things back to how it's always been.

    So to sum up, you’re asking if supporters can ask for refunds if the club doesn’t buy the number of players you want them to?

    As far I can see it - at this present moment in time the board of directors are putting the club in jeopardy.
    The trap door is open and we are looking at a long season followed by relegation.
    We were sold promises (eg Jacob Brown money reinvested etc) - at this moment in time those promises are false.

    And all of that is valid - but it doesn’t mean we’ve any grounds for refunds.

    It does mean they’ll struggle to sell many for next season though, if things remain as they are.

    It is for that reason and that reason only I think they’ll bring players in, because they know for a fact people will withdraw financial support if they don’t.

    Your post states they should buy the number of players that you want. That is what I meant.

    But I will change it to clear up any ambiguity.

    Conversely, are the owners saving money now to compensate for the huge possibility of lack of funds in the future?

    They’re not that daft I don’t think.

    A club with 10k season ticket holders is worth a lot more to a buyer than one with 5k.

    I honestly think they’ll cash their chips in soon, I can’t see them staying long term. They’ll want profit, so know they’ll have to speculate.

    As will I.

    If we are relegated this season having not signed any players in this window to try and avoid this, and having made a cheap and poor head coach appointment, this could well be my last season as a ST holder under these owners.

    I will buy one next season, even in league one, if they’ve at least made a few signings, and sorted out the mess with the Cryne’s.

    They'll bring players in because, despite their obvious faults, this myth that they're happy owning a League One football club is just that. A myth.

    The season tickets were sold based on availability to see games, nothing more, nothing less.
    If they fail to make them games available you could have a case under Article 75, but given it was sold through a third party even that makes it a grey area.

    If you’re complaint is you were mis sold under false pretences, that comes under Salesbof good act not Article 75.

    Depends how much they think they need to spend to keep the majority of our 8k season ticket holders.

    8k season tickets @ £250 = £2M. It's less than that because of kids as well. So how much do they need to spend to keep half ST holders? Got to be more than £2M, so It's a no brainer for the owners. I think they've made their minds up.

    I hope you're correct and that they will sell up soon. However, how long did it take PC to find the current owners

    But how do they benefit from us being in League One? Because it's easier to trade players and make a profit? That would make sense if there was any evidence that they're taking money out of the club.

    Also, why did we spend so much money bringing Struber over if we didn't want to avoid relegation? Saddle ourselves with Ritz's wages, bring in Sollbauer, etc.

    I know there's plenty to be aggrieved at with those in charge, but on this 'claim' I just don't get it.

    Possibly, but relegation will cost more in the long run I would imagine therefore I would have thought they would try everything possible to stay in the division. The only way they could possibly cover relegation would be to sell a couple more first team players and invest nothing in new players...... Possible.

    You’d only buy BFC during covid if you’re a lottery winning lifelong reds fan who doesn't mind blowing his money. No fans in stadiums until there’s a vaccine and no ST sales to speak of next season. Who would buy a football club in todays climate ?
