    Would they be obliged to give it to him? If not, I don't see why they would.

    Because they accepted an offer to sell him (as part of the loan deal) without him requesting a transfer.

    It's all very complicated but there will be terms in his contract that mean he is entitled to some payoff in various circumstances, and Wigan probably now don't want to sell him so probably are working through the legals to see if they do.

    Football used to be a simple game....

    I suspected that would be the case. If the positions were reversed I'd be expecting us to do exactly the same thing - if not to get out of the deal completely then to make it as difficult as possible for the buying club, and mitigate our losses as much as possible.
