Am I right in thinking Flicker would have had to resign...?

    If he had stood by Keith and declined the caretaker offer? Therefore placing him in breach of contract and running the risk of dismissal without settlement? Alternatively resign his position, again without settlement? It sounds like the club might have had him over a bit of a barrel. This is Robinsgate all over again! :confused:

    constructive dismissal must come into this? to appoint someone as assistant on the basis of an other being the boss then sacking the an other. makes his job as assistant untenable and unworkable?

    not that i know f all about contact law like just guessing !!

    It inevitable they're going to have to pay him off as well, wasn't he on the same money as Hill?

    Can't see any other manager coming in and not choosing their own assistant.

    Why? Might as well get some work out of him for our money. Redeploy him around the club as required, if he wants out he will have to resign. Sounds a bit harsh but why settle a 100k+(?) contract even though that might suit Flicker, but then so might continual employment.

    The way I see it is that the board have asked him to look after the team only for the Peterborough match, not as a medium term deal.

    I would be surprised if the club were deliberately so petty as to try and force him to resign without paying any compensation - doubt that would stand up in a tribuneral anyway as taking sole charge of the team wasnt his job.

    I am guessing they havent really thought through what happens next and no point sacking him until they know how things are going to pan out
    or worryingly might even be thinking of giving him the job on his own

    After what HR at my last employers were up to in an attempt to reduce the wage bill, nothing would surprise me!

    Yep. He declines and he is failing to follow a reasonable instruction = disciplinary offence which could lead to dismissal. He can resign and dependant on the contract, he would leave with 0. Will be a true test of their friendship now as Keith will presumably have received a settlement. Mebbe Keith should be offering him 50%?

    I don't get why we have offered him the job to caretaker us. What is he getting out of it? Surely he wants the job now unless he might know the potential new manager keeping him as number two
