It's not even judicial review is it? Thought it was just being looked at by Criminal Cases Review Commission?
2 seperate points - Evans doesnt have any appeal in progress - what is happening is the Criminal Cases Review Commission is investigating whether there is a possible miscarriage of justice - This isnt an appeal as such The Birmingham six is as you say a massive miscarriage of justice - caused by the fact the Police needed to get a conviction and manipulated the "facts " - I dont think there is any suggestion of a similar conspiracy in the Evans case
Until a decision is forthcoming from reviews, whatever there nature, then it's most unlikely that any football club will go anywhere near him, due to the vociferous nature of public opinion, as what we're witnessing at the moment
How would people react if there was some new evidence brought forward that the CPS had to overturn the original outcome??? I also can't work out why Mcdonald was acquitted but Evans was found guilty, if she was too drunk to consent to Evans then surely she was too drunk to consent to Mcdonald aswell.
"Verlin Rainwater Solutions, which sponsors Oldham's main stand, has announced that it will end its association with the club if Evans signs."
This has been discussed before. The logic is along the lines that a girl getting a taxi with you - travelling to your hotel and going into your bedroom and getting her kit off reasonably can be construed as giving you grounds to believe consent had been given getting a spare key walking into the room tapping your mate on the shoulder and saying " when you've finished its my turn" is a bit different
I'm sure I read that there is cctv evidence of the girl clearly unable to stand up, falling over in a fast food takeaway and also leaving her handbag in the food place aswell.......so surely she must've been way too drunk at that stage to consent as opposed to an hour or so later when Evans appeared.
I think the issue is whether the man can reasonably assume consent was given so even drunk you can be deemed to have given consent by your actions - you must admit there is a difference between the situation of the 2 - or as others have said a lot of men have had sex with a girl who wasnt completely sober at the time and could be in trouble if that was the only criteria. Not sure there are quite so many who have taken the approach Evans did. The Judge in his summing up directed the Jury it was perfectly possible to find one guilty and one innocent of the rape charge based on the evidence. He also said it was possible to find both innocent or both guilty as well.
