Of course you're entitled to your opinion and just because many don't agree with it doesn't make it any less valid. My opinion is that he is currently a convicted rapist (this is a fact). Whether it was rape is a matter of opinion but one thing is for certain and that is, as you say, rape or not what he did was disgusting and for that he should show genuine remorse. I don't think his apology is sincere in the slightest and this for me is the basis of the whole problem with him coming back into football.

Well said Mario. Some posters put their opinions and if they are continually challenged on it start bairning that they can't say owt without getting abuse etc.however I am aware that some have been abused or threatened and that is totally wrong .but one or two complaining of this have claimed it on the basis that people have challenged them and need to grow a pair imo

Wasn't court for the hearing so I can only assume that those who were made a considered opinion based on the evidence presented.
Somebody yesterday posted they would potentially rape someone if perceived consent was retracted during intercourse. Probably gives some clues.
Just a shame the video thingy didn't work on his mate's/brother's phone, as he was trying to illicitly record the 'consensual' sex through the window, because then Evans could have given this as evidence. You know, when she got on the phone and invited him over and then answered the door when he politely knocked... ...wait a minute, the only invite he got was a text off his mate saying 'got a bird' wasn't it. Whenever I have had a text like that I have always took it to be an invite to hot foot it over there, argue a key off the night porter, sneak into the room to watch my mate and then ask a very drunk girl if I can join in. And obviously when Evans got the text he rang up and spoke to the girl, charmed her so that she invited him over...no, hang on, instead of speaking with her he told his mate/brother where he was going, what he would be up to and to go to the hotel window and video it, so they could have a laugh about it later. Perfectly normal behaviour. And if we're talking about consent, well who is better placed to be giving consent than someone who is off her face, having sex with someone else, when somebody she's never seen before just appears in her room asking to join in?!? Ask any sober girl now what their reaction would be if that happened to them and they would be horrified. But she wasn't sober was she. Far from it. And she no more gave informed consent to Evans than she would have given consent to the blokes he had arranged to be outside the room trying to film it. There is no way he would have tried all that on with a lass who was sober and in control and therein lies the crucial part of the story. He took advantage of a girl who was in no state to give an informed consent, but who he took to agreeing to something that no girl I've ever met (and I'm a nurse, so I have known some pretty game lasses in my time) would ever consent to. Seriously, despite what Loaded and all that tell us, it isn't the norm for someone to go to a hotel and have it away with someone she just met in the chippy half an hour ago and it is most certainly not the norm for a girl having sex with someone in this situation to invite a third person to join in when he has suddenly materialised at the side of them. Miscarriages of justice do occur and they occur far too frequently. However, the above is how things happened according to the court papers and the father in law's* Ididn'tdoanythingthatIanddozensoffootballersbeforemehaven'tdonepreviouslyandgotawaywithsometimesbecausetheclubshavepaidthegirloff website, or whatever it is called, states. The only difference being that there are different interpretations of something that most probably did happen, i.e. she said yes. The difference is, Evans took the yes at completely the face value, whereas the more reasonable jury could see that she was in no position to give an informed decision, he took advantage of her and with all the rest of the sordid evidence proving that Evans is an unsavoury sort and had one thing in mind, that is rape! *I actually find it staggering that the father in law is standing behind Evans on this, because I wouldn't fancy facing mine if I had acted like that!
In my case it's because having considered the evidence called at trial I cannot, on an objective analysis of it, understand how the jury could be sure of guilt. Just that really and 20 years in criminal practice including plenty of rape cases. Don't care for Evans, just another Blade before all this but can't bend what I truly feel about the case on that basis. Appalled by the wild eyed, hysterical, pitchfork wielding lynch mob mentality that threatens our democracy as mealy mouthed politicians join in with a view to winning a few cheap votes. The whole thing has become an absurd and embarrassing indictment of modern British society now seemingly controlled by the faceless fools of Twitter. Sweet moderation, heart of this nation? Not anymore it seems.
No one appealing a conviction can apologise for the crime because that is tantamount to admitting they committed the crime and would nullify any appeal. I can justify why I don't want Evans at BFC but can't find a reason why he shouldn't be at any other football club. In the absence of any valid reason the 'lack of apology' issue has been latched on to by a number of posters to justify their argument for him not going to any football. It's a spurious reason. And those who object to his going to any football club can't claim to believe in the rehabilitation of offenders. A friend who has experience of courts and prison when discussing this case with me said that in court Demeanour is everything - come over as arrogant and self-assured the jury may dislike you...did Evans' demeanour contribute to his being found guilty. He also pointed out that it should never be assumed that juries are made up of intelligent, thoughtful and prejudice-free people. A final 2 thoughts on this my last post on this subject If Macdonald texted Evans to say he'd 'got a bird' wasn't he as guilty as Evans of that rape under the Joint Enterprise law. (past midnight - can't remember second point!)
