how longs parking at asda in barnsley?

Went shopping about 6 weeks ago and got a fine through for being to long in the car park.... Obviously after that amount of time I've not got receipts to prove we were shopping.

My other half drives and she's panicking she will get taken to court or get bad credit..... Id be quite happy to sling it!

 

How long were you parked there? Usually supermarket car parks have a notice up saying free for 2 hours.

 

2 and a half hours we were there.... Spent all that time shopping though so surely they cant enforce it?

 

Maybe not, maybe so, but there should be some sort of course you have to go on if you're spending 2 and half hours in asda.

 

I had a similar thing in Asda Rochdale, spent nearly 3 hours parked there with my sister doing a massive shop for a family party we were having. I rang the Asda and explained - ask to speak to the manager of the store . Also sent them a long letter explaining the circumstances. We had our fine cancelled.

 

Wouldn't have thought they would bother taking it court over something as small as a parking fine, but you never know. It does seem incredibly harsh, particularly as you were shopping in their store. Had they known that I'm sure they would not have issued you with a fine. Obviously, after six weeks, you'll not be able to find the till receipt, but did you pay with cash or card? If it was with a card, you'll have the transaction on a statement. Might be worth replying telling them you were shopping in the ASDA store for the entire time and, if you did pay with a card, telling them you can show your statement should they require it.

 

It was our lass looking at everything.... Had something to eat as well! How can they charge you if your spending money in the store? I think we paid on card so might be able to get proof of using store but no times.

 

Is it the Narnia branch of Asda you went to?

you mean well, but that is old advice.

Is it Excel Parking Services or similar ? Parking Eye ? It is not a fine, and is not legally enforcible (only police or local authorities can issue a fine). What you have received is a PCN, or an "intention to prosecute". The old advice was to ignore, in the hope they would not find it worth their while to prosecute. But they chase everything now, and can use your ignoring against you if it ever came to court.

The key in your appeal - do not use an excuse (forgot the time / didn't see the display / queued at checkouts etc ....) they will NOT work. Instead, use one of the above groups to download the carefully worded reply which they cannot turn down. It uses words to the effect that their charges are punitive or not commensurate with the nature of the 'offence'.

Also, from memory, when you appeal to the body that issued the 'fine' don't use the wording I mentioned above.

Just tell them that you disagree with the PCN and could they kindly issue you with a POPLA code with which to appeal. They HAVE to supply this. Use the code and the downloaded wording for your appeal to POPLA.

If you paid by card just get a copy statement to show you were there. By the way I'm not aware of any notice's up in ASDA car-park (I could be wrong). I often park up there, do the shopping, browse the DVD's and laptops, etc, then pop into the café or pop into McD's for a coffee and I've never had any trouble. I would definitely challenge it.

Asda have very little sway over cancelling the 'fine' (which is not a fine). The landlords employ the parasitic Parking companies and it needs a 2-stage appeal to challenge.
1) To dispute the PCN and ask for a POPLA code with which to appeal.
2) Use the code to contact POPLA with a carefully worded statement (available to download).

If you paid by credit/debit card there will be a record of the actual time that the card was used, down to the actual minute/second. This info should be held either in the store, or at your bank, or both, in which case you should be able to prove that you were actually in store for the duration of your stay.

 

And whatever you do in any communication do not say you were the driver. Reply as the registered keeper. You lose a lot of rights once they have you down as the driver.

But as said above - challenge it - do not just ignore it - and so long as you follow the rules should get it cancelled. Scum they are.

 

Its their whole business model Jay. They rely on people just coughing up or challenging wrong and dropping themselves in it.

My mother got done down there once at xmas after she spent best part of 4h and £400 in there on shopping and presents etc. and just paid it before i found out. Id have taken the lot back in and demanded a refund unless they paid it for me.

 

Write a letter telling them you will. Shop elsewhere if that's how they treat customers

And tell them you will spread yhe word to all your family friends etc
