Credit card payment dispute

    booked a hotel in France through booking.com months ago.

    Stopped there in mid July with a couple of mates and paid the bill €135 in cash

    Just got my credit card bill this morning and the hotel have taken a payment of £1124 off my credit card on Aug 1st. I only ever gave my credit card details when booking through booking.com to guarantee the booking.

    I have called barcleycard to dispute and they are investigating.

    As this happened to anyone else am I likely to get this back??

    You stand a good chance with a Barclay Credit card. Happened to me when I was in Belgium.
    I pay for Legal advice on my Home Insurance but it didn't cover the dispute I had with the hotel
    I stayed at in Belgium. In the end I signed up with WHICH Magazine Legal Services.
    It was circa £15 per month. When they accept you all you do is write out your grievance and
    send it to them. You have to register a number where they can contact you.
    Shortly after a top Barrister phoned me and talked me through exactly what I needed to do.
    I wrote to the hotel and the tour operator Expedia. After many weeks and the threat of action
    through the Court they refunded my money with an amount for inconvenience.
    Luckily I had kept my receipts. If you go down that route make sure you know the complaints
    procedure of the party you're complaining about. Expedia' s was a response within 30 days.
    I kept getting frustrated and wrote to complain on four separate occasions. What that does is cancels
    the previous complaint, so technically they kept me waiting 120 days before responding.
    The Barrister said that's not unusual they hope you'll just go away.
    If you don't get any joy with Barclays your other course of action is to complain to the Banking Ombudsman.

    Not happened to me, but you should get your money back as the merchant will have to prove what the payment was for and that you authorised it

    I use Booking.com regularly and have never had a problem with them. Sometimes hotels take the payment in advance, sometimes when you leave but it looks to me that someone has just pressed the wrong buttons when processing the payment. I'm sure you will get the amount credited to your account soon.

    Yeah credit cards usually have to refund the transaction whilst they investigate as well.

    Barclaycard are jointly and severally liable for the transaction because of the effect of section 75 of the Consumer Credit Act 1974. You therefore have rights against them and you can probably be assured they will sort it in order that they don't become liable themselves.

    Yeah they have suspended the payment for the time being and won't form part of my bill, interest etc. Got to fill some forms out when I get them.

    Just very annoying

    Sounds like they are receptive to your claim. You should be OK AT.

    Not via Credit card (don't have one) but first time we used Melia Hotels directly we had a **** up with the bill.

    When booking we put debit card details in and was told at the time and on the confirmation e-mail that the payment was 100% non refundable deposit (in other words......paid).

    On checking out of the hotel we were given a bill for the same amount. When we questioned it and showed them a copy of the e-mail they checked again, made some calls and assured us it hadn't been paid. Luckily we had enough cash on us and paid up upon being asked to check our bank account when we got home. We were also given direct contact details with the reservations manager at the hotel for if it had been deducted.

    When checking at home it had NOT been paid so they were right.We informed them, they then investigated and it was a glitch in their system so failed payments can happen.

    At least they were very nice and understanding with the problem and we have used them a few times since.


    I now always check ANY advance booking has been debited !

    We wasn't given one that I remember anyway.

    But the bill was €135. If they had taken that off I could have understood but I have not authorised a payment of over £1100.

    I have all the booking details still saved with booking.com

    Would have thought if for any reason they wanted to take more than the original cost I would have been billed they can't just take a random payment

    You didn't trash the room did you? Or watch a lot of pay to view channels whilst emptying the mini bar?

    non of the above :). hotel was a shithole to be honest, we only went for the rugby and wasn't bothered where we stopped, no tv in room

    But even if we had caused any damage, which we defo didn't. can they just take it off credit card??

    Yes they can - you gave them the card as a guarantee so they can charge things you havent already paid. In the case of a reputable hotel they would send you an invoice with a breakdown of charges you hadnt paid in the same way a car hire company can take money of your card if you have pranged it when you take it back

    But this doesnt sound to be the case here - its probably a genuine mistake somewhere and will all get sorted quickly

    I had a barclaycard cloned once and started "buying" things in India - got a call from their fraud department asking me where I was when I said in Farnham - they said that I presumably didnt just buy a carpet in Delhi - which of course I confirmed - they just send me a new card and a list of all the suspect transactions for me to confirm there werent any I actually made and it was all sorted - no problem at all
