Simple letter before action stating She has 14 days to either provide you with a list of alleged faults in writing to rectify at a time suitable for both parties or payment in full. Failiure to respond after this deadline leaves you with no choice to pursue the money outstanding through the courts plus costs to be awarded at the judges discretion. Or pay a couple of smack heads to turn up and Pay her a visit.
Blimey no!!!! You can post it on here though if you wish. If you can prove your case and she's got assets (not the ones Nudge is an expert on) then a small claim may be worth the effort. It may even become a matter of principle. What is most important (IMHO) to know is that your District Judge is trained to decide cases upon documentary evidence whenever he can. He needs summat to hang his judgement on. He hears one person saying it's black, and another saying it's white. He hears absolute contradictory ******** day in day out. He doesn't want anybody appealing his decision. So he goes for what can be documented. Invoices, reports, cheques!!!, owt he can lay his hands on to justify his decision, if necessary, at a later date. So make sure your paperwork is in order, and thus come to equity with clean hands.
I wouldn't have told you anyway. I've kept copies of everything and have call logs on my phone. One of the things this lady has accused me of is being abrupt when I called to ask for payment, and she's used that as an excuse not to talk to me. Everything else has spiralled from that. I wasn't abrupt. I know that's not the best way to get paid, plus she was talking about repeat work - why would I risk that by being rude to her? She's not a young woman, and I think maybe it's time someone was dealing with her affairs. Hopefully someone in her family will intervene and sort it.
