Is it possible that Wigan could be saved because both Derby and Sheffield Wednesday are fined the maximum 21 points?
No matter what you think of our owners, if the appeal is successful I'd hate to be up against our lawyers if it'll potentially cost us 8-10 million getting relegated ......
Just read article which had this as part of it: So, the facts as set out are that in the middle of the coronavirus crisis, while football was still shut down and many clubs fear going out of business, Au Yeung decided to buy Wigan Athletic, a club which even in normal times loses millions of pounds. pretty damning I would have thought.
Why? If it worked and they remained a Champ club, they might get more pence in the pound of what they are owed.
I thought that in order to get approval to carry on in the EFL there's a requirement that all football debts are repaid in full before the claims of other creditors are tackled.
My only worry is why throw 500k at an appeal if they don’t think they have a good case. Should Wigan’s points be overturned I feel the EFL will feel pressured to act up on swfc’s points deduction this season..we’ve got two throws of the dice in my opinion. should we still be relegated football is officially f***ed
Surely the administrator's duty to act in the best interests of the creditors will involve obtaining an opinion from the QC on the prospects of success of appeal. Whether it is justifiable to pursue the appeal will then be a question of whether the A < B*C where A is the cost of pursuing the appeal, B is the loss which will result from relegation and C is the percentage chance of the appeal succeeding.
I would have thought if the appeal was upheld, EFL would have no choice but to appeal, thats when it gets real messy as there is no way it could get heard soon enough for the new season, that leaves them with a either leave as is with Wigan relegated and appeal will be taken care of next season or relegate us until appeal is heard next season. either way incredibly messy for obvious reasons. In short, there is no way EFL can allow an appeal to be successful as the implications are too grave for them and everyone involved.
