Some morning papers reporting that wigan will refuse paul cooks resignation. Not sure how this works but if he is still contracted i believe a figure of£900k compensation has been chucked about. Anyone know how this works...ie does he have the right to terminate his own contract ?(therefore leaving the latics without a penny).
I'm not a lawyer but I would imagine he'll have a case if Wigan have not been paying him in full without a written agreement, either due to Covid or Admin.
but according to our ever correct and wonderful BBC this morning we will have to wait a week or more, even after the appeal tomorrow, it is abou time the EFL grew a pair and stood by their own rules
In normal employment you can refuse to accept it but legally they can’t stop you leaving. Can’t say for certain for Football as it seems to have its own rules at times over employment and certainly players can’t just walk out of a contract(although I suspect that may not actually have employment contracts). Would suspect if true Wigan are doing so if he pitches up at Bristol they will try to claim compo.
I guess the only way they have a case is if the one of the owners old or new, had signed an agreement confirming they will cover costs?
I don't think it will have been an EFL decision to allow us to be involved. Much more likely down to the panel itself.
it depends on his contract but as long as Wigan havent breached it from their side he cant just walk away - contracts work both ways so its the same as a player cant just walk away whilst under contract either. Of course if Wigan have breached the contract on their side - eg by not paying him then its a different matter. Just entering Admin doesnt allow employees to tear up their contracts
Yes I was thinking this myself last night - imagine how the EFL would look if they reverse their decision on Wigan's appeal and send us down, then in two weeks time, with still no buyer, Wigan don't pay us the installment on Moore/and or their players and staff? That's not going to be a good look.
Well the old certainly wont have done that - I think the whole point of the ownership swap and administration was precisely to stop covering those costs. New Owners are not in place yet but even if one did agree to cover all the costs, that could not be an agreement in place at the time the appeal was launched. The fact is the club has suffered an Insolvency event. so the rules are quite clear -12 points

They have stood by their rules tbf , they’ve apportioned a 12 point penalty for going into admin . This is an independent appeals process .
If it’s cut and dried the decision should be fairly quick so would expect to hear at the start of next week. If we haven’t that’s probably when we need to start worrying.
Imagine how it would look if Wigan win their appeal *and* are not subsequently taken over *and* they don't pay installments due sending other clubs into admin. They could potentially screw us three ways.
