I thought Oakwell Community Assets owned the council half of Oakwell Holdings? That’s how I always understood it.
There's quite of lot of companies involved in BFC these days: - Oakwell Holdings - https://beta.companieshouse.gov.uk/company/05308191 - BFC Data Services - https://beta.companieshouse.gov.uk/company/11549831 - Oakwell Community Assets - https://beta.companieshouse.gov.uk/company/04916500 - Barnsley Football Club - https://beta.companieshouse.gov.uk/company/04573250 - Reds in the Community - https://beta.companieshouse.gov.uk/company/06081731 Quite complicated really, innit.
It is. Just to make matters more complicated, Oakwell Holdings is controlled by Mr Andrew Mark John Openshaw-Blower, appointed in 2016.
Whatever's happening, having your Directors fall out to the degree of bringing legal action against each other isn't particularly heart warming.
Were we more stable, and reached a pinnacle, under a Grocer in charge of a single entity? Footy is way too complex a model for me these days.
I wouldn't disagree. The High Court is based in London not Manchester. There are High Court Sheriffs based in Manchester but they are appointed to recover debts incurred as a result of judgments already made and this link shows cases where judgement has been passed and no mention of Oakwell Holdings (you can do a search). Unless the op can post a link to verify the assertions made in the post we should treat them with a pinch of salt. https://www.judiciary.uk/judgments/
This is correct. This is a massive assumption, but Cryne’s company has debtors which are reducing at a rate of £1 million per year. Taking into consideration that the company is only in existence to hold Cryne’s shares in the club, the debtor almost certainly will relate to the consortium buying their percentage of the shares. It could be that they haven’t paid what’s due, for one reason or another. It could be something and nothing, but it’s certainly not positive.
No, it holds Oakwell completely. The only asset owned by Oakwell Holdings Ltd is a £2m investment bought in the year ended 30th November 2018, which is the period in which Chein etc took over. This investment could either be for Cryne's % ownership of BFC Ltd or for Crynes 50% ownership of Oakwell Holdings Ltd - It does state that the share capital of Oakwell Holdings Ltd is £4m, so it could be that they transferred their share into Oakwell Holdings but if this was a disagreement about Oakwell, I would think the case would need to be raised by Oakwell Community Assets Limited. There's 2,000 ordinary shares in issue for BFC Ltd at the minute, all held by BFC Investment Company Ltd in Hong Kong.
Cryne hasn't had his pocket money paid on time and has the monk on because the local paper shop has run out of wine gums it's taken so long so he's had to buy a 20p mix instead.
Sounds like one party will have agreed to pay the other party, an instalment or purchase of an asset (ground or batch of shares) and that it is running late or has been reneged on. Court action may be an automatically triggered by-product (think big boys CCJ). Would be ironic if the reneging party is claiming force majeur as an excuse! Hopefull storm in a T-Cup.
In that case I apologise for spreading misinformation of my own. As I say, I was always under the impression Oakwell Holdings owned the stadium with Community Assets holding half of Oakwell Holdings. As has been said before, it’s certainly not a good thing. I don’t think it’s completely doom and gloom though. Let’s wait for more information before assuming anything.
A Manchester based lawyer who, in his own words, acted for for businesses and business owners in a variety of sectors. I suspect this ownership structure is fairly common. https://uk.linkedin.com/in/mark-openshaw-blower-30761626
It looks like Manchester Civil Justice Centre also serves as a "High Court District Registry", so what you say is not true. They basically have satellite places throughout the country. The reference number relates to a Chancery Division case. These include (from website): The most common types of case we handle include: disputes relating to business, property or land disputes over trusts competition claims under either European or UK competition law commercial disputes (domestic and international) intellectual property issues disputes over the validity of a will (‘probate disputes’) We also hear appeals about: decisions of masters insolvency decisions made by High Court registrars or the County Court most decisions of the County Court decisions of certain tribunals
The investment would be shares in BFC Investment Company Ltd. The investment was effectively nil, until the club was bought out. Oakwell Holdings has 20% interest in BFC Investment Company Ltd, who in turn wholly own the club.
The Directors of Oakwell Community Assets would suggest a lot of Barnsley MBC involvement although Patrick Cryne was a Director until he passed away. https://beta.companieshouse.gov.uk/company/04916500/officers
