This statement tells us exactly nothing. They are willing to sell their 50% share to the holding company of the club (which they own 20% of themselves so they’ll presumably still own 10% of the stadium after the transaction), and say there’s a previously agreed price. What isn’t said is why this price is now presumably being disputed; we also don’t know what has changed in the two years, we don’t know if an independent valuation of the stadium, facilities and land is of higher or lower value now and we also don’t know if there were other contractual issues in the initial deal which the majority owners feel haven’t been met. Having ‘previously spoken to counsel’ means little as there’s no indication when this happened and any advice could well be outdated, and the fact they are prepared to go to court doesn’t mean the court would find in their favour - after all the other party are apparently just as willing to take it to court. We need a statement from the other parties, but we won’t get one. If we did it would just likely contradict this one with little facts available to decipher which is right. I’m starting to become convinced that there’s blame on both sides here, not just one. Probably more on one side than the other, but I’m not putting all the responsibility on one side, based on the little that has been said. The Cryne’s are very quick to put out statements to paint themselves as completely innocent - but they haven’t ever really told us anything. I actually really hope I’m wrong and that it’s the investors who own 80% causing all of this, but I’m not concluding that currently.
Makes me laugh when fans say james and Jean arent proper supporters only patrick cared. James and jean attended more games last season than anyone else on the board.
To be fair to the Crynes they have stated their position at a time when a media source states that we may be playing away from Oakwell, I await a response from the Conway team but won`t hold my breath.
This gives me more hope that things will be resolved. As others have indicated it seems the consortium are trying to get the price lowered. If this is about money rather than principle I am sure some compromise can be reached. Just being played out in public is messy and embarrassing
Whatever is the issue, required input from 2 leading QCs to try and resolve it. Therefore, the issues are probably technical or maybe a ‘grey area’. That doesn’t mean the Cryne family are in the right though. And neither does it mean the Club are in the right either. All these statements provided, by all parties, do not specify the actual issue and what has caused it., as it’s sensitive information currently. Until that is known, then nobody knows either way in full who’s to blame.
We're probably at the point in time where, assuming proceedings were served immediately, the pleadings in the litigation will be available from the Court if anyone can be arsed to obtain copies.
Problem with your senario is as its a commercial lease the 80% mob are responsible for the up keep of Oakwell so if it had deteriorated in the last two years because it hasn't been maintained correctly that's their fault and they are liable for the cost of repairs.
I don’t think that’s the case tbh, the 20% owners are also liable . They can’t have all the plusses and non of the negatives .
Am i imagining it or has Paul Conway at various times when been asked at these fan question times or interviews about buying the councils half. he has said on a number of occasions that talks are ongoing, talks are going well ,we are in contact with them and we are nearly there or things to that effect . And the Council have come out and said there has been no contact at all between them and the Investors.
Generally speaking, resorting to law is the option of last resort that no one really wants unless its a slam dunk win for one party. I think it's the Cryne's that have initiated so they must think they have a good case. No doubt BFC Investment will counter claim. Very, very, very sad that this couldn't be mediated. Lawyers win.

I hope the truth doesn't come out too quickly, as it is much more entertaining when everyone has their own conspiracy theory, based on whether they lean towards supporting the owners, BMBC, or the Crynes. If James Patterson is not too busy on a new novel, I hope he has time to chime in with his thoughts.
