I raised this because I always understood that a Publican could refuse to serve anyone without having to have a reason. I think this can also be said for shops and supermarkets should they choose. It seems to me that anyone with a genuine reason not to don a mask would be happy to furnish the prove
Not at all. A Publican can refuse to serve anyone without giving a reason. A person not wearing a mask as the right to not provide proof but they don’t have the right to insist on being served.

Wrong I’m afraid. If a person states they are exempt then you are breaching the Disability Discrimination Act by asking them for any further documentation or proof. The very act of asking them to provide it is a breach, so it can’t be done.
I don’t disagree with you but that doesn’t mean that the they are entitled to be served. The conversation would be: Good afternoon landlord , I’d like a pint please. Good afternoon sir, could I ask you to put a mask on please. I don’t have to landlord for medical reasons I do not wish to serve you sir, kindly leave the premises. End of l would expect that the next time ‘sir’ went into the Pub he would be wearing a mask or brandishing the medical proof.

Are you treating me different to how you would treat other customers because of the same again contary to the Equalities Act? The exemptions and the no challenge aspect are designed as much to protect the business owner and their staff as it is the customer. Apart from the fact someones medical history is no ones business but that of the persons claiming exemption. For example I am freinds with a woman who doesnt wear a face mask due to PTSD from being raped. What 'proof' would you ask from her? What about refusing someone who has Austism who gets really bad anxiety with a face mask lives an almost fully independent life but wants to take their support worker out for a birthday pint. Asking them to prove they are disabled would more than likely destroy whatever confidence they had. What about the bloke out with his stone deaf grandmother who relies on lip reading? They wont come back with proof. Theyll at best go somewhere they are treated as equals and their custom is welcome. At worst you/ your business gets a day out in court.
in the past yes but its 2020 you can't discriminate against anybody. But you can refuse to serve a person what is deemed to be too drunk under duty of care or anybody's causing harm or discomfort distress to others.The best outcome would be to close all hospitality but Boris's will not do this because it will cost him billions more venues are really struggling at the moment it's a horrible position to be in
Your first point fails I’m afraid, simply because a Publican/Landlord can refuse to serve anyone without explanation. They are perfectly entitled to bar anyone without the need to offer any justification what so ever. As to all yourremaining emotive points, it was never my intention to suggest that landlords must or should excercise this right in regards to masks. I’m sure most landlords are perfectly capable of using their discretion over this issue. In my initial post I was merely pointing this right out to @Dillydilly which I’m sure he understood anyway My view of it is that it is a few selfish people who are abusing this loophole who are spoiling it for the genuine cases.
Don't blame the police blame the Muppets who won't wear a mask. You should have to prove you are exempt and because I don't like wearing one isn't a reason. All we have to do is follow the advice given by the experts but sadly there are too many who won't so we will end up in a total lockdown again and the biggest moaners will be the ones who can't follow simple advice and a few rules and have caused the upturn in infections.
Look I have a solution for everybody who doesn't want to follow any rules or take the advice given by experts it's this, Sign a form stating you refute all the evidence given to you by the experts and wish to carry on as normal but in the event you contact Covid you will remain at home and won't bother the NHS for medical help. If youre prepared to sign that fine carry on as normal if not shut up follow the rules and let's keep this bloody disease under control until we have a vaccine.
