It's a pen in the sense that he was touched by the opposing player, who didn't touch the ball, but that touch was not sufficient to bring him down. He took another step before throwing himself to the floor and earnt the penalty, he could have stayed on his feet, but felt the touch, so dived and its cheating.
He has a history of cheating/conning referees, and there’s another one. A better referee wouldn’t have fallen for it.

It's hard to prove conclusively either way whether it was enough to make him fall, but it's immaterial really, it was a clear foul. Personally I think it's easily enough to impede a player and at least make them lose balance to an extent, which is enough for a foul, especially in a dangerous area of the pitch.

The touch doesn't have to be sufficient to bring a player down, just needs to be enough to impede him from getting to the ball. Unfortunately refs will never give a foul when a player stays on their feet, so the players have to make the call for them.
