I wasn't going to ask on here, but after being inspired by Gally's post, why not? A couple of weeks ago my neighbour built a new fence/wall between our properties, where there has never been one previously. Not an issue at all, he let me know ahead of time that he was going to be doing it, no problem at all. The issue is, when he's put it up I think he's come quite a bit into my property. I had a quick word with him about this yesterday when i saw him outside and he seems to think he hasn't. I'll put a picture at the end to try and demonstrate, but from looking at our documents, it seems like the boundaries are in different places on each of them. the Green is our borders according to my registry document, I'm the one on the bottom. Red is where his wall is and where his deeds say the boundary is. Not really sure what the way forward here is, wondered what people on here would do. It's not the end of the world, that side of my property is just loose pebbles anyway, but I don't really love the idea of losing a chunk of land or if I ever want to redo my drive. For anyone wondering, the reason it's like this is that originally there was a garden at the bottom right of my property as angled below, which meant the extra angle was needed to make a drive on my property when they were built. This is why I'm quite confident my documents are correct.
Depends what documents you're each looking at. If you're looking at the HMLR title plan and he is looking at an actual transfer then his is more likely correct.
I'd concur with that. As I said in Gally's thread, it's the Deeds themselves that need reviewing, title plans are only indicative.
There is too little information provided, for a definitive answer to your problem to be supplied. What is without doubt is that you need to sort your problem out sooner rather than later. If you ever want to move, you will have potential buyers put off by deed plans that do not match the on the ground reality. And by then it may be too late for you to rectify it.
Have you seen his deeds or are you taking his word? If you haven't seen them, ask to take a look. I know from personal experience that some neighbours will say black is white in order to get their own way.
