eBay / PayPal problem

    Back in November 07 I sold a mobile phone on eBay. The buyer had just received 1 negative comment, and he was a new user with only a couple of positives before the negative. Anyway, the transaction went through fine. He paid promptly through PayPal, I sent it when I'd received payment by Special Delivery, next day. He received the phone the following day and we mutually left positive feedback for each other. His feedback seemed that he was happy with his purchase and the speed of the delivery. No further communications were entered into.

    Then yesterday I received an email from PayPal saying that I had 10 days to respond to a dispute on that same item! Apparently it was out of PayPals hands as this was a claimback from his credit card company. For some reason it seems that he wants the money back for the phone which he still possesses. PayPal have a section on their dispute form to send any evidence so they can fight the claim on my behalf, as apparently they have a dedicated team that try to resolve these issues for their customers. The thing is that I don't have any evidence now to prove he has had the phone, and it is now upto the credit card company to see who the money should be given to. I did have about £150 in my PayPal account, but they have taken out £87 for the phone while this is going on. It is being held by PayPal and they will give it back to me if the decision goes in my favour.

    The only evidence I could provide was the fact that he had left me positive feedback, therefore he has obviously had the item, otherwise positive feedback wouldn't have been left.

    I am quite pissed off by this to be honest. Has anyone else here had this type of problem before? I wonder how PayPal would have gone on had I not had the funds in my PayPal account already? Would they have taken the money from my bank account?

    I had something similar. We didn't send the mail recorded so we couldn't prove it had been sent, so paypal took the money off us. Luckily it was only a jumper for about ten quid!

    There's some cnuts on there that do it for free stuff.

    i sell on ebay all the time surly if you sent it by special delivery(next day ) you should have a postol proof

    Yeah I sent it by Special Delivery, but this was 4 months ago! As soon as I have received feedback I discard of the slip - I never thought I'd need it again. Lesson learned - never sell on eBay!

    It is not always feasable to send things by recorded delivery, especially if the item is say a tenner. I have just had 9.99 taken out for a paypal dispute, but I had the proof of postage you get from PO's and they still gave the decision to the buyer. I have appealed & threatened to stop using paypal if it is not reversed.

    just to check you say you used recorded delivery?

    Would that be "Recorded Signed For"?

    There are some real conmen out there. So even if you have proof then it doesn't mean you will get the decision. Having no proof makes me hold out little hope, but if thats the case, like you I will never use PayPal or ebay ever again. Why would this guy leave it so long? 4 months is ridiculous and should have shouted up by now if there was a problem - which obviously there isn't. Then there's the fact that he left me feedback confirming that he had the item. I would have thought he doesn't have a leg to stand on on that evidence.

    Any of you that has replied, has feedback been received for the items you sold?

    No mate, I used Special Delivery, which is signed for, but high insurance and guaranteed next day delivery. But like I say, I have no proof of this as it was 4 months ago when he left me positive feedback, I would surely not have any reason to keep the slip then.

    I always thought after 90 days they had no rights?

    If they can wait this long they don't deserve rights. Bloody foreigner!!

    Not all foreigners are con-men, but how come all con-men are foreigners!

    Oh yeah, sorry. You could always try contacting royal mail with his address and the date that the phone was delivered to him and see if they have got the signature still?

    From Ebay:
    You can open an item not received or significantly not as described dispute 10-60 days after the day on which the auction-style listing ended or you bought using Buy It Now (the "transaction date").


    You can escalate the dispute (via the "I feel I have no other option but to report this seller" option) after the seller has responded at least once, between 30 and 90 days after the transaction date.



    And here is the key bit:

    If you haven't resolved or escalated the dispute within 90 days from the end of the transaction, it will be closed automatically. When a dispute is closed automatically, the seller is not reported to eBay's Trust and Safety team and no further action is taken.

    And it is also confirmed on this one at the bottom where it clearly says that even if you have filled in a complaint form you only have "90 days after the listing ends"

    They might not have it so long after the date but it's worth a try. If they do have it still then i'm sure that being able to provide them with the date and address of the item's delivery along with possibly your address (i'm not sure if they ask for that when you use special delivery) or the post office it was delivered from then they would be able to help.

    If not then you can bring up the 90 day thing and use it to your advantage by arguing that after recieving positive feedback about the delivery you knew that the buyer was happy as if not he would have not left the feedback, however just to be on the safe side you kept the special delivery proof but you discarded it after ebays 90 days had elapsed. It would be very hard for them to take any action against you if you show that you only threw away the proof due to their 90 day policy.

    You say he/ she left feedback, surely this is enough for PayPal to rule on your side as why leave positive feedback if you haven't received an item?

    Thats my point exactly! Surely there would be no case for this reason alone. It doesn't take a mathmetician to add a simple sum.
