    He wasn’t sacked. Garden leave is a suspension. He’s only left when he joined Hearts. That’s why compo is being requested.

    DS knows this. There’s a big cash difference between the two....

    Yes he does, clearly and emphatically. He states his contract was terminated with immediate effect.

    So if he was sacked all the money up to end of contract gets paid to him?

    If he's on gardening leave? Please fill me in cos I honestly dont know.

    You better tell Daniel this because he clearly believes he was. Even Conway refused to confirm he was still employed by us in his radio Sheffield interview, so I'm wondering where you're getting your information as it's not from either the employee or the employer.

    I think he’s mixed up in it all. He was clearly removed from his position with immediate affect., we know that. But a termination in contract v garden leave is a big cash difference. All reports state he was still on pay role - which means he wasn’t. The club could also use gross misconduct against him I guess too - which means they wouldn’t have to pay in full.

    I genuinely think he’s got it wrong.

    So maybe the club should have spoken to his agent/lawyer and spelled it out to them I'm sure Budge at Hearts will have requested to see any relevant communication between Stendel and the board to ascertain if they might need to pay compo.

    I was told that too by someone at the club. Its clear there was no love lost and the board wanted shut.

    Flip that the other way round - maybe Stendel and his agent should have asked for clarification? If he was still receiving a monthly BACS payment from BFC that should be questioned....

    Rubbish (happens ALL the time) they have used this to get rid ....because of his constant complaining for experience players.

    If you read his statement it says the club wouldnt talk to them.

    Why talk to the club though? Get them reported! That what Preston said they'd do if anyone tapped up their manager.

    He's not denied what Conway has said about sniffing around another club and planning to take his coaching staff with him. I liked Stendel, he was a man who loved it here but I don't like that he's not denied what Conway's said. Like other posts I've seen, in Struber we trust.

    Whats key players staying got to do with the coach? This board have outlined the way players are allowed to leave (ie with a year left and if they dont renew they are sold).....,oh apart from the other times when players are sold with 2 years plus on their contracts. The coach has nothing to do with players staying, he has quoted many times how he was dissappointed with losing player's.

    Genuine question as I don’t recall, if he has then your question is a fair comment.
    If he hasn’t perhaps we have or as you say why not

    You can’t dismiss someone summarily (gross misconduct) and put them on garden leave. Summary dismissal puts the contract at an end

    Red Helen - garden leave is remaining on the pay role for the duration of your notice period. You are not required to attend work and receive your full pay and benefits for the duration save for your holiday which is deemed as taken more often than not. The contract remains in tact.

    The alternatives are:

    Dismissal on notice which is the same as the above but you have to work your notice period. The contract remains in tact.

    Dismissal with payment in lieu of notice. The contract ends immediately but there was a payment made which represents what the notice period would’ve been. More often than not the payment excludes benefits and so it is just the basic pay.

    Summary dismissal where the employee leaves immediately without pay or payment in lieu of notice. This is cases of gross misconduct and obviously the contract ends immediately.

    it is not uncommon to put employees on garden leave - usually to prevent them from working for a competitor or it sounds in this case (if it happened) to keep him under contract so we would receive compensation if he wanted to join another club (with the added benefit that we stop paying his salary once he gets another job) .

    He just said they were talking to that club, though what about I cant imagine other than pay us some dosh and we wont report you?
