So that reads to me as the EFL/FA are happy to let two clubs resolve and only get involved if needed(bit like a transfer).

Gross misconduct for what? He hasnt gone anywhere, if he was speaking to another club (happens all the time) then bfc should be going for an illegal approach......so in the first instance, complaining to the club involved. Something the board hasnt denied happened. Nope their spin on this was aimed at getting rid of him and they sacked him.
But no one has gone anywhere, different when the board tell us a player wants to leave etc. This stuff happens loads....enticing others does imply a bit more but really?

it makes no sense. We are angry because DS was trying to entice CS and DT away and yet the moment we get a new coach in we replace them anyway. We could have got compo if it was common knowledge DS wanted away why wait weeks to sack him? If it was only revealed sometime after the fact then how could the turmoil be blamed for the poor results?
It'll all come out in the wash. This is a case of two businesses involved in a legal dispute. It wont be a trial by jury based on opinions. It will be based on facts - facts supported by evidence. If I was a betting man, I'd put my money on Hearts and BFC eventually coming to an understanding, with an undisclosed amount heading our way. But obviously I could be wrong. Just my gut feeling.
Yes it does happen all the time but it doesn't mean it might not be breach of contract. Often fans complain about players doing what they want (transfer wise) while under contract, they get away with it and it's widely accepted but what if a club decided to execute clauses in the contract? Something similar to this would occur....
If we take Stendel at his word then you have to assume that he was not in contact with any other club before he was sacked. If he had been he would have mentioned it in this statement as he is honest and straightforward. You believe this to be true. I defended Stendel initially when he left because rumours about him being in contact with with either Boro or Sunderland did not ring true. I have no idea what the facts are but I now believe he must have been in contact with someone - otherwise the whole thing makes no sense whatsoever.
Yes. That was my point. If he was talking to others, then there is a case for Gross Misconduct. He leaves immediately, no additional pay but conversely no future compo due to us. If he’s on Garden Leave - which reports seem to confirm, then he’s still paid monthly and we’re entitled to compo and don’t have to stump up a settlement either straight away. If he was dismissed with payment in lieu of notice, then he’ll have a fat lump of cash in his account and be free to do what he wants. The fact the club have kept quiet for so long and only just released a statement now, as well as Stendel getting a job pretty quickly, says to me Garden Leave. If he was settled up in full, usually the manager has a period agreed where he can’t work for so long afterwards - like Hecky did after Leeds.
