If he's a delivery driver and he needs it for his job then he should be using hands free so clearly he just has no regard for the law or the safety of others so you should report him. Could you record him driving while using his phone and give it to the police as evidence.
Just log the time and dates you see him doing it, then phone the police and give them the details. They might pay him a visit and warn him that they could ask to check his phone records to see if they tie in with the information they've been given. Might be enough to make him stop. Otherwise, yeah, just record the ****.
