I’d disagree, I think it is an issue. But then I agree with your last part, it’s probably way too messy and complicated to have one rule to cover every team that goes into admin.
Wednesday and Derby cases depends on when there's an outcome. The way I read the statement was that whatever independant body are hearing their charges have not reached their verdict yet, let alone a penalty. Chances of a deduction in time for appeal to be done before the official promotion & relegation takes place (I think it's the day after the play off final), are slim. So any penalties would be applied to next season. Which, does stink, given the crime gave them an unfair advantage this season.
I may be wrong, but isn't the basis f their appeal slightly different from prior appeals? I thought they were arguing that a) the pandemic has been the main cause of them being insolvent(*cough* ****** *cough*) and b) the FA failed to act responsibly by allowing the crook of an owner to buy them in the first place, and then again by allowing him to sell the club to himself for some dodgy financial reason. It shouldn't make a difference though. Whatever happens, will rumble on in the courts for ages. If they relegate Wigan, they will sue the FA. If they relegate us, we will sue the FA. Also, if they overturn Wigan's punishment on grounds that it failed to protect them from ******** owners, it will open the FA up to more litigation from the likes of Bolton, Hull, Blackpool and Bury who would surely fancy their chances at suing them for loss of earning or some **** like that...
I doubt Wigan will sue the FA, for two reasons...the case is paper thin anyway..and I doubt they have the funds for a potentially multi million pound legal case.
Throwing half a million at it is worth the gamble. At the end of the day they really haven't a leg to stand on. All the L1 & L2 clubs have had no fixtures, other than the playoffs & not one has gone into admin as yet. These cowboys have ridden roughshod over the rules. If they get away with this I'm done with football for good. What is the ******* point having a competition if the rules are meaningless.
Justice? They literally spent more than they could afford and had to go into admin. There is no comeback. Enjoy league 1 Wigan.
It’s so typically Barnsley FC that we have this hanging over us. Yes, over the course of the season we were the 3rd worst team, but it’s not a level playing field when clubs are flouting the rules. Surely if this appeal is won the EFL would essentially be admitting their fit and proper ownership tests are flawed? There must be more to the story than what we’re privy to if Wigan feel they have a case, or is it just for show to try and appease the fans? I feel sorry for the fans and I feel sorry for the manager, but the rules are clear. How pundits and players can call it an injustice is beyond me!
Yes I hope justice prevails as well - its the fact it might not that is concerning. its not as if the EFL are famed for their just approach
I’m no legal person and I can’t be arsed to read and try and understand something that I know nothing about so.......to the legal people here amongst us, how likely is it that they will get it overturned based on what they are trying to portray to the courts?
