Them starting on -12 next season would probably be the worst outcome to take. The season finishing late can't be "unforeseen", because they voted for it to happen. And the argument that July 1st was after the end of the season is a nonsense. I If that is the outcome, they've escaped based on some loophole, rather than the rights and wrongs of what has happened.
Increased revenue would help compensate for the deduction, whereas present they lose that as well. As I said remotest and all clubs voted to continue. Personally I don’t think it’s valid. It is a slim chance and a loophole but that’s what Solicitors often win on.
Nobody knows though. His opinion is a valid as the next blokes. We're all just guessing right now. In fact this whole 23 page thread is pissing in the wind at it's finest.
If they reduce the points deduction the EFL are not really punishing them at all and it could set a precedent for chaos in the future. If you don’t get punished when your owners do something dodgy, when are you going to punish a club? Going forward we’d have what, different levels of administration? With only very dodgy decisions getting 12 points? At the end of every season you would have a series of hearings as clubs argued they were a special case.
Prediction: Wigan have their circumstances taken into account, but are found to have gone into administration and so should be punished as per the rules. In view of the unique circumstances which led to this point, the independent panel reduce their penalty to 10 points and we are relegated on goal difference, maybe reduced to 9 points and we go down by one point.
They really are firing abuse about us lol. They struggle to answer that they have been paying beyond their means. They use out of playing season as an excuse but clubs voted to continue. If they stuck to their actual budget once again ill Say, they might of finished below us. Realistically if we wanted to we could buy a position above them but we follow the rules instead. None of their points are valid what so ever.
Of all of their spurious arguments, that's the weakest. The definition of a playing season is in the public domain and unambiguous.
I don’t think it helps matters when people are calling their fans stupid, thick, and scrubbers. This whole debacle is just a perfect example of what it’s like to be a Barnsley FC fan. Nothing is ever straightforward. If they win their appeal then there’s not much we can do. Farcical? Yes. Would some of our fans get a taste of their own medicine after gloating on Twitter? Yes.
I don’t see how the season finishing late makes any difference to finances unless players don’t get paid in the close season. Matches played behind closed doors might be a factor but when they are played isn’t.
It is odd how two groups of people feel it's so cut and dried in their favour. There's clearly a case to be heard, the strength of it will only really be known to people that have read their appeal submission. I do find some of the Wigan fans on twitter to be quite condescending. One thing I do know, and I doubt any Wigan fans would believe me is, if we posted £7m losses, then £9m losses, then went into administration the following year, I wouldn't have a problem with a 12 point deduction. If things came out about dodgy dealings from the owners, I'd be more worried about being expelled from the league rather than getting points back. It will stink if Wigan get a reprieve, but I fear it's a distinct possibility.
Hmmm I stand corrected - reduction to 9 points then so that the principle is upheld but special consideration for Wigans Unique circumstances or something similar
Now I know this can happen I am 100% convinced we're going to get shafted. Tribunals have a long history of bottling cases by reducing the penalty applied.
If they have their points reduced then that’s no punishment at all so that can,t happen. Either they are let off or 12 points deducted. What will be will be what’s the point in speculating. Simon Jordan says they won,t get off let’s hope he,s right.
I don’t see any arguments towards the EFL with Wigan’s takeover. The EFL have no governance in company matters outside of the football clubs league membership. The EFL only have a governance relating to their league membership. Wether the EFL approved their new owner or not, in this instance is irrelevant as they don’t and never will, have the capacity to stop a sale of a company from one entity to another. Charlton for example, their takeover was concluded by transfer of the company, at that point the football club was under its new ownership, the EFL or any other regulatory body are powerless to prevent it. Charlton have problems with the EFL as their owners haven’t complied with the “EFL Membership Rules”. As their new owners have not proven validated funds to show they have the capacity to support club in the short and long term. It doesn’t stop the new owners, owning the club in the meantime. What would happen if they filed for administration? After this has been ongoing for several months the EFL are now threatening expulsion from the league altogether and possibly placing sanctions against their league membership, such as points deductions, transfer bans etc. It’s the EFLs only leverage. The same thing happened with Bury. Owners ran up unsecured debt, sold the club to a lunatic for £1, who thought he could steel the land around their stadium. Only difference was he didn’t put Bury into voluntary administration, it was forced as he had no intention of running the football club and the creditors were knocking. As a result Bury were kicked out of the league altogether. The only unprecedented thing is, Iv never known-of anyone buying a football club, to place it into immediate administration without any formal warning. However they were the owners of the club at that point in time, they can do as they wish, it’s a crazy situation but it’s happened. The immediate penalty is 12 points deduction, clear in the rules only right of appeal is force majeure which this case clearly isn’t. The only people Wigan supporters can blame for their demise is their series of former owners, not the EFL or other clubs.
Utter straw-clutching from me, obviously, but should that @RobboHarry fella on Twitter really be posting inside-information on there quoting directly from Wigan's QC, whom he seems to know?? Unprofessional at the very least...
