    Surely after all lobbying we have done this means Wigan will lose this appeal.....? Can’t believe EFL would hammer is like this?

    Did you know that David Phillips QC, Wigan’s lawyer, works for the firm that do the ‘independent panel’?

    You forgot Birmingham who committed the same offence as last year but escaped penalty because they thought it was unfair for them to sell players in January when the could get more for them in the Summer- bit arguable but in any case they had the benefit of players for an entire season that they were breaking the rules to keep.

    we might as well all go into administation, clear our debts and start again or just all leave the EFL and see who they can shaft then

    That must be grounds for a judicial review if Wigan win how can a panel sit in judgement on an appeal when the man representing the the appellants works for the same company as they do Stitch up of Barnsley FC coming once again.

    David Phillips QC has been instructed oversee Wigan Athletic’s appeal against their 12-point deduction by the English Football League (EFL) after the club was put into administration. His team is seeking to overturn the deduction on the grounds of force majeure citing unforeseen, exceptional circumstances beyond the control of involved parties.

    This has come as a bit of a shock if I'm honest... Got told last week it was seventeen and was being implemented this season..spoke with the same bloke last night and he was adament it was still happening... In fact i actually contacted 2 of the lads on here last week to tell them what I'd been told . such was the validity of my source...
    Chuff knows what's gone off ... No doubt he will be as confused as iam..... Wonder if they won a last minute appeal re points deduction...

    I agree with you but you’ve got to look at the legislation and the legalities of what’s currently in place. The rules surrounding FFP are not exactly black and white, It’s open to interpretation and loopholes can be exploited. the FFP is an aggregate of losing £39m over a 3 year period. It’s a stupid rule which in reality is impossible to police, accounts can run between 12 18 months behind. It needs to change. An open argument, is which season do you punish? This is where football and commercial practice implode especially in a legal sense. The people On the panel aren't stupid, if they impose the points deduction the past season without realistic warning, Wednesday will appeal and there’s lots of legal arguments as to why they’d win. then the process starts again, another year down the line.

    At least it’s come to a conclusion and the punishment is a lot more damaging to them than just -12 points next season when you take it into full context of their situation. It will be impossible for them to keep within the FFP limits going forward.

    The ironic thing is that FFP is in place to ultimately protect the club's in the long-term.
    Could Wednesday appeal the points deduction for next season ?

    In some ways, taking the whole package of Wednesday, Wigan and Derby into account, cheating is effectively being rewarded, or at the least condoned. All three clubs are palpably badly run/corrupt/dishonest yet all three at this moment could still be in the Championship next season. The whole job lot stinks.

    They could in theory, because there’s no set out punishment for breech of FFP. Although I don’t think it would end well for them if they tried.
