Everywhere I hear of seem to just send full year groups home. That's certainly been the case with my kids.
This is our 5th case now I think and it's only been the students nearby each time (until this one). It's all been a bit hush hush really and you don't get to find out who the student is or who's been sent home without some investigating.
We get a note to say that someone ‘in the year group community’ has tested positive - then they give the date that individual was last in school, because that’s the point that the clock starts - so for example my son got sent home on Thursday 15th but he has to stay at home/isolate etc till Friday 23rd (the latest day of half term!!!) as the last time whoever got the Vid was in the school environment was Friday 9th...
I’m surprised that we don’t find out as a member of staff though. I see thousands of students at break time.
I think the clue is in the fact that the landlord doesn't have to give a reason is what he is saying.. You just don't serve them. If you don't mention the mask or lack of you are not breaking a law.
That's not true though. If you have 100 customers stood outside and you let 99 white men in but stop the 1 black guy who lodges a complaint of racial discrimination you are going to struggle to prove that you didn't want him in for another reason that you refuse to explain. If you let in everyone with a mask but refuse to let in the disabled guy without one you are going to struggle to convince anyone that the reason was something else which you will have to make up and lie to the court about. Remember you don't have to point out your discrimination in order to discriminate.
Who said it was a guy and that that guy was disabled? Out of interest, if this person is not disabled what discrimination are they going to claim and prove?
Well as it was an hypothetical situation I made the person hypothetically male and disabled in my head. It's a very risky strategy guessing that you think they don't have a disability
I can’t believe people are debating this with people who actually know how licensing works and have had to take exams to understand it like they do. Or even got sworn in on their license in court. Be like me telling a plumber or electrician how pipes and wires are really fitted. And you can tell by that terrible description/example how rubbish I am at plumbing and wiring. To add some meat to the bones: - The Act for wearing a mask is the Health Protection (coronavirus, wearing of face coverings in relevant place) (England) 2020 - Taffs and Jocks have different rules! The exemption is reasonable excuse as is it is in all the guidelines under the Coronavirus Act. For example Severe Distress being a stand out one. The one that provides the biggest caveat is To avoid harm or injury Or the risk of harm or injury. This is essentially a blanket clause. To the man or woman in the street what the this would encompass is not quite as obvious. However it would cover anyone suffering from mental health issues such as Depression, PTSD, Anxiety in its many guises, Paranoia, claustrophobia and so forth. Again, ailments like Asthma, COPD etc which would to Joe Public not be apparent. Lets not forget "Long Covid" It is quite clear on the Government and other websites that you should not challenge someone for not wearing a mask. The only people who can request a non mask wearer about the reasonable excuse are as follows:- The Police PCSO Persons designated by the Local Authority or The secretary of State for the purpose of enforcement - Covid Marshals, Traffic wardens etc. Nor is there any legal requirement to provide documented proof eg a medical certificate GP's letter to ANYONE Anyone outside of the above requesting any proof is likely committing discrimination and harassment. The reason Mr Barkeep doesnt challenge is quite straight forward - you could be in breach of the Equalities Act and required to remedy the same. Not withstanding it is a fundamental breach to that parties right to privacy. A disability under the Equalities Act is basically something that puts someone at a substantial disadvantage. Substantial is defines as anything more than trivial or minor. A substantial disadvantage could be that a face mask causes the wearers anxiety to go through the roof. The business owner is required by law to ensure steps are taken to avoid the customer suffering any disadvantage, in this circumstance it would be the not asking about the facemask other than asking if they are exempt nor should any attempt be made to get the customer to cover their face while on the premises regardless of timescale. The business owner is also required by law to ensure reasonable steps that the exempt party is protected while on their premises from other customers who wish to challenge or harass the party without a mask. Even something as simple as having a company wide do no challenge policy and treat everyone with the same level of respect regardless of mask wearing. For example, If I am walking around Asda without a mask having explained I am exempt and some slopehead starts screaming at me, Asda are required by law to protect me up to and including the removal of said slopehead from the premises. If they didn't and I had to reveal to the Slopehead why I was exempt for my own protection, Asda would be breaching the Equalities Act and again would be liable to remedy it. As for the using the excuse that you can refuse a party who is mask exempt as they maybe a danger to others. Should you as a business undertake that action and the person who is exempt takes umbrage and decides to take matters further you as the business owner would have to provide evidence as to why that party was a danger to others for not wearing a mask. Good luck with that.
Your own posted example, even with the best of intentions is demonising someone. Refusal of service because they are medically exempt followed up by the I expect Sir will fetch proof or wear a mask next time comment. And No. I have no intention of withdrawing my comments regarding any connotations. I would rather they be proven as incorrect. I expect a long wait.
So I can go into a shop say I'm exempt no one can challenge this not even the police so how can you possibly get fined?
Hi Jay. As I recall you got bashed over the head and mugged a while back. Were the police & authorities as enthusiastic in their pursuit of your attackers as they are of folk having a pint together ? For the sanctimony enthusiasts amongst us, I abide by the rules of Tier 2/3 whatever. I just think we're hurtling towards a totalitarian state based on flimsy debatable science and never cease to be amazed at the enthusiasm for it shown by some of the public. Once you give the govt powers, you rarely get them back.
I know of a shopworker who was recently reported by one of the new stasi for not wearing a mask. Although she was in uniform she was outside of the shop talking to her son who lives with her and as an aside she is also exempt medically... and yes the police were there within the hour... what a f..king joke
