When will be know by? Are we guaranteed to lose points? Will it be this season or next season? If we get promoted and receive a points deduction next season we may have wished we stayed in league one
They are waiting to see how many points they need to knock us out of the top six , hopefully we win the league then they wouldn't dare would they ?
Similar offences by Birmingham and Rochdale were punished with suspended points deductions. Objectively we should get the same, but there's always that lingering worry. If we get an immediate deduction I'm guessing we'd have pretty solid grounds for appeal bearing in mind the precedent, but then again I'm not a lawyer.
Whilst we don’t know the exact details of our charges, it seems Birminghams were slightly different in that they allowed people to take control of the running of the club prior to passing the Owners & Directors test. They also entered into an agreed penalty of suspended points that only come into effect if they breach the OADT this season and paid towards the EFL costs, this suggests they negotiated a deal as opposed to being ‘punished’. Also bear in mind every appeal seems to result in a reduced penalty.
This worries me to be honest because I don't trust the Efl. Yeah a sensible 'fair' punishment should be suspended, or a fine at worst.
You can see it coming can't you.We get second spot by two points over Bolton and they then give us a three point deduction !. What's taking so long ? surely this isn't a complex case ala Everton,Man City etc. They are obviously waiting to see were we finish.
Been a long time coming either way. Everton's investigation was 8 months. Reported 13th july The last one bothers me. And not sure if we reported ourselves entirely in good time. Obviously not in reference to shares if correct. I'm Guessing the rest of the volunteered information. And shares were flying around the directors. At the time of the request. The EFL have said that the Tykes have failed to provide the league with "correct and/or complete information regarding the beneficial ownership of shares in the club" despite a request for the information by the League. Barnsley have also been charged with failing to provide "necessary notifications regarding the ownership position" and "failing to publish accurate information on the club’s website concerning the ultimate owners of the significant interest". The other two charges include "allowing individuals to acquire a position of control without prior clearance from the EFL" and "failing to act towards the League with the utmost good faith". Former club directors Paul Conway and Chien Lee have also been charged with "causing the club to be in breach of EFL regulations".
If you take the Birmingham example the 4 directors in question were also charged and banned from being a director again, that’s how I read the last line, in that PC & CL will be banned. That said I did wonder if it would reflect on the club if one or both of these refused to cooperate with any hearing/questions.
They do seem more serious then the Birmingham ones - we are glinging to the hope that self- reporting is going to help, not sure about that- generally if you walk into a police station saying you murdered someone they don’t let you off for telling.
