    The difference is if a cis woman rapes a woman, there's 0 chance of them being impregnated mate. It brings a whole lot of new problems if there's a pregnancy involved, especially when the father is imprisoned for 30 years for manslaughter ( if i remember correctly). Id be absolutely fine making the laws equal in regards to females raping others.

    Edit - again, naturally, I just said father even though they're a trans woman. I meant no offence. Just mix up

    That's not what you said though. You said that you'd be happy for innocent men (including your son) to be banged up as collateral damage for an increased proportion of rape convictions. Arguing for a relaxation of the criminal burden of proof when it comes to rape.

    Forgive me if I'm wrong in such a sensitive discussion...surely males transitioning or fully transitioned to females can't menstruate?

    Females can't rape, they don't possess a penis.
    And it's not to do with impregnation, as men can rape men.

    This example just highlights how complexed this is.
    Where would a rapist who happens to be a trans women be put?
    I agree with both your points of where not but it does then raise the question of is it fair to the trans women and their rights?
    If fair then could a rapist guilty of raping men claim they shouldn’t be in a male prison?

    Hope that makes sense as my brain hurts reading it and I wrote it!

    No, a trans woman won’t menstruate. A trans man could though. Someone assigned female at birth who transitioned into a man

    I think they’d have to be segregated on their own. Wouldn’t be able to be in general population in a male or female prison. That should honestly be the norm for rapists no matter their gender in an ideal world.

    You seriously think it's OK for a transwoman ( a biological male who committed a violent male crime) , should be put in a women's prison? Thank God for the Supreme Court for clarifying the law as it stands and how it always stood.

    I still.dont understand how having committed a crime that only males can commit that there ahould be any ambiguity about it, Male prison of couse, there are trans wings. They also have the right to wear appropriate clothing and have accessories like wigs.

    I did a tour of Armley prison as part of my Magistrate training. When we toured Block F, which is for vulnerable prisoners, there was a trans female prisoner in the sewing workshop alongside the male prisoners. At the end of the tour, and without anyone having asked a question about it, the guard who'd showed us around explained that they would be treated as a male prisoner as long as they had male sex organs. This was a policy instigated due to a number of sexual assaults having taken place in the female prison, presumably New Hall, by similar trans female prisoners prior to the policy being changed.

    It was fascinating seeing the prisoner in that environment. The guard said that she had a single occupancy cell on the block, and her presence there hadn't caused any notable issues. From what I saw in the few minutes we were in the workshop she was just another prisoner on the block, albeit very different in appearance to the others. Given that it's a block where everyone on it has some vulnerability that keeps them segregated from the general population, it was interesting to see the dynamics between her and the others.

    I realise I'm replying to a post about a theoretical trans rapist, but there was no indication that's what this prisoner was serving time for, and I'm not implying such. I'm mentioning it because it was a particularly memorable part (one of several, all unrelated to each other) of a fascinating prison visit, and relevant to the more general question of how trans prisoners are dealt with, at least as far as Armley prison goes.
