a late but serious question

    Do you think its right that a woman can keep going through the cycle of having a child and then phoning in on long term sick after maternity leave has expired. A relative of mine has done it 3 times not and in past 4 years has worked a total of 4 weeks. Just coz its council she knows she can get away with it??

    No, sack her

    Tribunals take into account both sides of the argument.

    If it costs the company a couple of grand in unfair dismissal, better than having this maligering baby machine taking the piss.

    I would sack first, ask questions later.

    Sadly, it's not always a question of right and wrong.

    If she's off with post-natal-depression, then it's very hard to touch her, as she'll have you for indirect sexual discrimination.

    Trust me - it's a bloody minefield - that coming from me, an HR Manager!

    oh i know its a minefield, but its just bloody taking the piss. she goes in for a week then straight back onto long term sick, but is always rubbing my sisters nose in it by telling her how easy her pregnancy's are and she recovers so well

    You're right - it is completely taking the piss. That's often the case with public sector, though.

    Problem is that sacking her could consitute sexual descrimination, and there's no limit to the amount that a tribunal can award, so it could be very costly.

    The simpliest way - get the council to change their policy... but that's never gonna happen, is it?

    You could try and manage her out of the business by strong use of an absence policy, but you'd need to demonstrate consistancy throughout the workforce etc etc.

    It's a tough one, mate!

    i'm just looking forward to the time when shes too old for kids and has to go back to work. me i'm spending the rest of my life falling over raised paving slabs and ringing claims direct.

    I understand that sickness abscence is a performance indicator now public sector organisations and is funding linked- so provided that all procedures and legislation are applied with local authorities now seem more eager to take action against people who are classed as long term sick.

    Lasses have to have bairns and too right they should have a few months off.

    Some take the rank piss though, and most tribunals will see through it.

    I've sacked maternity malingerers before, some take it "on the chin" some fight it but I reckon I've always won financially. Can't be carrying payroll costs for glassback mothers.

    Sack em early doors if you think they are taking the Michael, trust your judgment.

    The woman at my work who runs out admin department only takes-on female staff who have been through the menopause - so they don't end-up taking the piss with maternity leave...!!

    As of 01 October she could be in a lot of trouble as Age Discrimination law comes in.

    My work's full of people taking the piss with sickness. We have 600 people, and 450 have taken more than 10 days sick in the past 12 months. That equates to well over 10,000 hours lost in the past year... Obscene.

    My boss tried to pursuade me to take his speeding points the other week, as they would have moved him onto 9 in total.

    £500 was my price. He's never got back to me.

    He could have me whacked for a fifth of that, it seems...

    We have over 300 employees

    and sack most of them the moment one walks into a chemist and demands a pregnancy test kit. On Principle.

    Costs less in unfair dismissal rather than paying their wages to do nowt.

    It's like having any contents insurance in yer house - pointless.

    Been burgled before but what can they nick? - 2nd hand plasma (£300) DVD (£20) Stereo (£500) etc - all really worthless but premuim is extortinate. Excess is a good few quid an all.

    Buy a ferocious dog and chain it up - cheaper.

    Let's hope you don't get anyone who understands the sexual descrimination law, then...

    Would love to be able to do that but the publicity of a tribunal for a big multi-national like ours would do huge damage. Having said that, the girl whose job I got is trying anyway!

    I've taken 2 sick days in last 4 years

    People are not generally ill, just a cold or summat that is workable, load of balls.

    That seems to be similar to my reasoning.</p>

    Maybe its a Darfield/Wombwell thing.</p>

    Anyway I'm off to my mums to get some kip so the rabid mouse doesn't eat me.</p>

    2 days out of my house due to a little mouse.</p>

    6ft 2 wimp.</p>
