Basically I have returned to work today after 11 weeks on the sick after nearly severing my index finger and the feckers are trying to give me a warning
Presumably you kept them informed and have doctors notes or something, in which case I don't think they can do that. Unless it's unrelated of course and they've checked your computer while you've been off and it's full of porn or something.
they are trying to give me the warning for having the accident even though there were no procedures or risk assessments in place
They have to do it It will be in their insurance policy guidelines. If they don't do this it automatically shows that they accept liability. Has their insurance company contacted you yet to take a statement, or have you even registered a claim.
They have a responsibility to you as an employee to risk assess your role and provide all relevant materials to limit or minimise the danger or threat posed to you in that role. Obviously, don't know the full extent of what has happened there, but you could have a case to make a claim against them for failing in a duty of care.
what utter ***** ! they should have carried out a full investigation of the accident involving all concerned before any warning , my guess is they will not have so they will have pre judged any warning. Saying if they do not warn you is admitting liability in law is utter tosh .
I don't believe I mentioned the law. I said they would be acting on guidelines from their insurance broker / company
ask why you have been warned.Ask for it in writing. did they follow company procedures or acas guidelines if they have none.
