On the 16th June I had a very nasty accident and did not return too work until the 1st September, during that time I had a doctors certificate that covered me for that period of sickness.i have gone to put some holidays in today and they said I havent got any as I had them in July whilst I was on the sick. Now my arguement is I was either on the sick or I was on holiday, I have checked my pay advice notes and there is no mention of holiday pay on them.</p>
usually you do not get holidays counted if you are off sick. All the places I have worke have been the same. If you had been on statutory sick pay you would not have been paid hoiday pay as well. So then you would be owed the days. Just because they were paying you doesn't change the picture, you should still get teh holiday days. Ask the HR department for the employees handbook, they should have one that outlines all the policies about sick pay, holiday pay etc. Who told you this, your line manager or HR ?
I am the line manager, it is my production manager, he says that because it was a factory shut down and I wasnt there i've lost them, but when we have shut downs my area doesnt close.
check your contract 1st but i worked at a couple where they tried the same on some and as far as i know,you should still have your full entitlement,cant take holidays off you if you were sick!now if its a fixed shutdown..then??? but as you say you dont shutdown,then they should still be yours to take as you please, snake at ours went sick half way through tuesday so he'll get paid for the strike today,and no doubt be the same on monday for the next un!
