Advice Please!...What can I do about my neighbours and their pain-in-the-arse extension?

    Our neighbours have built an extension and loft conversion. It has resulted in their property been slap bang next to our drive, instead of about 7ft away like it used to...

    In the process of building it, they had to cut away a bit of the tarmac of our drive and damaged more further down the drive. They also put scaffolding on our drive...which we agreed to (we were told it would be up for 3 weeks, it was up for 5 months) which meant we had to park half on our lawn/half on the drive, ruining our grass. The big lorries delivering building supplies/scaffolding have broken the manhole cover on our drive, leaving three spikey pieces of iron and a hole to drive our cars over. They keep saying they will sort it, but have done bugger all. To top it off, their TV aerial now overhangs our drive and birds keep crapping on our cars!

    The tarmac of the pavement/road in front of their house is stained with cement and there are dints/damage to it. Looks a right eyesore

    What can we can do about it...apart from me potting their windows?

    anything over hangs yur boundary you are entitled to shift it...

    bushes trees owt...if it overhangs then its on yours and you can cut it back. also did thay have planning permission...may be worth asking at the townhall. and if they have encroached upon your property (your deed will soon show the boundary) then they must remove or buy that land from you.

    Town Country planning Act, Party Walls Acts.......

    1. Did they have planning permission?

    2. if yes, has extension been built in accordance with approved plans? electronic copy (PDF) can usually be obtained from council's web page e.g. www.barnsley.gov.uk and then look for public access page in planning section.

    3. If they do not have permission or the building works do not comply with the approved plans then contact council's planning team. They will visit site and if plans do not comply with approval they can issue and enforcement oreder for it to be taken down.....

    4. Party Wall Act 1996 is another document that may be of interest. I am not expert but advise that you google it and read up on it. There are sections covering situation you have decribed. You are better to do it though the right channels, rather than

    More like bite his ankles....I'm only a little lady!

    Cheers for all that....been on the web...I live in Rotherham...they did have conditional planning permission...granted before we moved in unfortunately....but wont give us much info due to data protection and that. It says planning permission was agreed on the condition that:

    "1. Before the development is brought into use, the whole of the area to the front of
    the dwelling abutting the highway shall be properly drained and constructed in
    concrete tarmacadam, block paving or other such material as may be agreed by
    the Local Planning Authority and shall thereafter be maintained in a sound
    condition.
    2. There is to be no parking in any part of the turning head in front of the dwelling."

    Both of which they haven't stuck to...the front of their property is just muck and raised manhole covers....so as a result they are parking both of their cars on the street. Even if they had it sorted, I don't think they have enough space on their drive/garage to park them both.

    Hmmm might be worth giving Rotherham council a call.
