Oops, forgot to submit post! Here goes..... Presumably adjourned for a pre-sentence report from Probation Service? It is pointless wondering just yet about what the sentence could be, unless the Judge has said in Court that immediate custody is inevitable. Which Court is it at....Sheffield Crown? Are you allowed to say the Defendant's name?
Doesn't really mean anything I'm afraid. You will find that most people who are remanded are either there for public protection or a fear that they will abscond. What usually happens now is that a report will be prepared by the probation service which should inform the judge about sentencing. Sometimes the judge will offer indication about what they are looking for in this instance. Bearing in mind that it is wounding I would expect that the starting point would be custody, but since the last Criminal Justice Act theres been an increased use of Suspended sentences, so who knows. Do you know what the actual offence is, because sometimes these matters do get plea barginned down, which can be a real insult to the victim.
not a particular increase of susp sentence, or should i say, non-custodial, just easier to justify for the judge as it doesnt have to be exceptional reason to make a susp sent. anymore.
After reading your other thread Ali, I reckon your mate is looking at about 4 Years. One of my mates did exactly the same thing last year (apart from the plank smashed the bottle before going for the kid) and got 4 1/2 years in May. With good behaviour he will be out on a tag in about 6 months. hope this gives you a rough idea of what he's looking at.
If he's got a false passport & a fake moustache (Muslim) .... (dunno) whats happened....sentencing whos that then ???? (doh) somebody of here....Bright red had nowt to do with it did He....
Because it is easier to get a suspended sentence with supervision I think that the Courts probably are now giving more suspensions. Whether this is at the expense of custody or community orders is difficult to gauge. In my experiance of working with the courts I feel with offences like wounding that Suspended sentence Orders are becoming more common whereas before the CJ Act you were more than likely to go down.
hmmm, interesting, look up the neil kibble article on it. its new and a goodie. based on glozzer and brum crown courts. wounding, = custody, anything less abh or s.20, susp is a good chance.
Jimmy Jazz and johnb, may I ask................................ just out of interest which parts of the Criminal Justice System you are in? Serious question.
more and more, i reckon we should front load the cash on rehab. far cheaper and far more effective, even if they keep failing - keep trying.
