If someone is foung guilty of common assault but given a conditional discharge does this person now have a criminal record and would it appear if a CRC was done at some point in the future.
Not a lawyer but IIRC: A conditional discharge is considered spent after 12 months, at which time said person would no longer be obliged to disclose it. It will not appear in a standard CRB check which is fine for most jobs. Some occupations which carry exemption from the Rehabilitation of Offenders Act - generally ones which involve work with children - require an Enhanced CRB check. It almost certainly will appear on that.
or if its for immigration purposes you need to add it or else you will get found out and your immigration application will be rejected and a ban imposed
