Falsely accused and very p*ssed off

    Got falsely accused of shoplifting today. Was searched without a word of apology for their error based on **** all evidence.
    Really irate!!!!!!

    Anyone had the same happen to them?

    They must have had cause!

    You didn't keep walking around the shop looking at lots of differant things or go into the shop 3-4 times during a short period of time?

    once got accused in wikinsons in barnsley and was held for half an hour for the crime of going into the shop 3 times. once was because wilkinsons is the main entrance into the allhambra from the top so i was just passing through. second time was to go and check the price of something in there and the third time was after i had gone to get my sister to come and have a look.</p>

    We were still on the aisle in the shop when the guard grabbed us for shoplifting and held us in a room for half an hour despite the fact that the only thing they found on us was the product (i forget what it was now) that i was holding in my hand, quite clearly not hiding it.</p>

    Didnt get so much as an apology either</p>

    Politely remind the security guard that he does not have the same powers of arrest as the police and indicate to him that you do not consent to being searched or to remaining in the store. If he wants to keep you there he will have to effect a citizens arrest and you will hold him liable for false arrest should he choose to do that and it be proved that you did not take anything.

    It's a common misconception that a store 'detective' /guard has the same powers as a police officer, they don't. If you choose to voluntarily wait for the police to arrive then that is your choice, the only way you can be forced to wait is for him to 'arrest' you ... which is no more than a citizens arrest.

    Thankfully any arrests these people do make are legitimet ones as it usually some scroat who has been caught red handed on CCTV. When it's a decent person [which I'm assuming McCarthy is] then they should think twice when challenged.

    The only reasons given

    was that i was carrying a rucksack and left the store without purchasing anything. I picked two items up and then put them back and left the store after realising the queue was long and i had to catch my train home.
    I didnt go in and out of the store several times, i didnt dawdle about (didnt have the time).
    I am suspicious because i carry a rucksack ffs! I had just finished work and it had my work gear in it. I have done this every day after work in the same shop for the last three years.
    So its either a crime to carry a bag into a shop now or its a crime to leave and not buy anything!

    I'm not sure where you stand on an issue like that.</p>

    Did they lead you away? Did you stand your ground and refuse to move while they searched your baggage? Is that enough reason to stop someone, and did they apologise afterwards?</p>

    Can you claim damages for embarrassment - after all, people around who didn't see the conclusion might always remember you as an arrested shoplifter.</p>

    Maybe it was further down the same side...I dunno, this was in the afternoon, getting slightly tipsy before going back to Barnsley.

    I can't for the life of me remember the name of it though.

    You should have a word with the Police. A store detective can't just search you .I'm sure that could constitute an assault of some sort. Contact a solicitor to see what they say.

    Name and shame them on here!
