will men of the same age be able to sue for sex discrimination for being denied the same government payment solely due to their sex?

They're not getting a payout "for not getting a pension at 60" they're getting it (if they do) because the changes weren't communicated in the way they should have been.

Ok but will men of the same age get a payout for historical sex discrimination?

Are you meaning why men had to work longer for their pension?

DWP have already said they will not abide by the ruling, so no pay out yet, without further legal shenanigans.
So the answer to your question would be No.

Lots like my Mrs will have missed out on something like £50k. Born in 1957. The formula was flawed at best. And speeded up by the coalition government.
Financial planning went out of the window.
£3k compensation. Is the most recommended by the ombudsman.
    As for men
School leaving age was raised in 1972. By 1 year (no leavers in 1973 unless special circumstances or 5th yrs) . I never understood (apart from the fact it saved money) why mens pension age was raised to 66. By oct 2020. When it would have made more sense in working yrs/NI contributions. for me in sept 2021.
Having a fixed age is also flawed imo. Depending on the type of work people undertake. Manual labour takes its toll and generally means less able to do the job the older you get.

The extended life thing is also a bit of a myth, yes, we live on average slightly longer, but the myth part isn't because we are healthier or whatever, its because infant death has dramatically reduced, so it looks like we are living longer when in actuality its not all that. Saw Ben shapiro the other week saying there should be no cap on retirement age, saying should work for as long as you're healthy, he said whilst sitting in his multimillionaire comfort of his office - just sitting and talking all day for a living. He rightly got a tonne of backlash, including a vast majority of his own supporters.

Tbh I dont know how a variable state pension retirement age could work. And how could you deliver it based on certain criteria. But there has to be a maximum age regardless.
The emergency services armed forces etc. Will look at capabilities but have normal retirement ages way below state retirement age. They can continue if able to do so.
Lots of people carry on working beyond state retirement.
Some out of necessity. Not having any other income or very little.
Some it gives em summat to do or social company. My mate is 71 and wishes he hadn't retired because of both of those reasons. (Wished he'd gone part time or job share )
Whereas I wish i would have retired much sooner than I did. Hating the job. But scared to make the jump earlier based on financial projection. Eventually going 9 months before state pension.

I completely agree and understand your sentiments regarding ability to work mate, I think there's lots of older people who enjoy it, either gives them a purpose/structure or ables them to remain social. But should be their 'choice'(even though as you rightly mention it isnt always a choice financially) after a certain age. They deserve to actually enjoy their retirement time after years and years of work, especially manual laborious work

You also could add on why.did men with children pay less income tax compared with a single person male or female. Marriage allowance?

We actually have variable pension age already P as anyone can defer their state pension to when they choose to take it afer their retirement age. I got lucky as at 55 the company I worked for offered redundancy and you had access to your company pension at that age, I took both and got a little 2 day job as a top up...never looked back and am now in my 1st year of state pension and fully retired..Back to the ladies and their claim I'm in agreement that they are right but don't see them getting any compensation, even Labour are distancing themselves from this one..

My wife is part of this. Born in 1957 (I think) she could have prepared for retiring a few years ago but had to keep working until she reached 66.
She is obviously following this with great interest.
No doubt the Govt/DWP will drag their feet until these older ladies die off then say that compensation was actually due to them, at which point it's too late.

Life expectancy from birth in 1945 was 64, it is now over 80.

Referring to the CMI, life expectancy in England at age 65 is 22 years for a male and 24.5 years for a female.

You can question many things but increased life expectancy is factual.

Another point to mention is that the main complaint is the government didn't write letters to each individual woman to tell them if the changes. They did of course discuss the changes repeatedly in the media both written and visual and it was covered at length for years.

Lots of changes are made in budgets. I've never ever received a letter informing me personally of them. I'm meant to just not be an idiot who can't comprehend what is all over the news. Bozo didn't write me a letter telling me I wasn't allowed to leave my house but I guarantee it would be no defence in court 'what lockdown? Nobody wrote to me about one'.

My mum has been campaigning for compensation for years. Guess what? She knew full well about the changes decades ago but if anyone asks, no she didn't. She took early retirement from her well paid job and now wants 10k in money owed to her because she's a woman.

Sorry but no. Equality is equality and sex discrimination works both ways. The old rules were CLEARLY sex discrimination and women, whether they had a hand delivered letter or not, should have known about the changes for a long time before they came into effect. Anyone claiming they didn't know is lying imo

You could and can defer it mate. The criteria changed around 2021 though, for withdrawal.
Before then you could claim the full amount in one lump sum. Since then if you defer it they will only pay it in instalments after you decide to take the state pension. And I'll stand corrected it is over many years. My mate had to appeal as he wasnt aware of the change at the time and got his full deferral back in one lump sum.

What you also have to understand. Equal pay is only in reference to Gender.
There is nothing stopping an Employer offering a job at less rate than someone already doing exactly the same job. Scandalous. Some running into many thousands of pounds.

My Mrs an RGN at the time was due to State pension In 2017 at the age of 60. She started getting it in 2023 due to the change in the law. In 1995 which phased it in between 2010-20. We are some of the fortunate ones who were able to plan ahead to some degree. But that went belly up due to circumstances out of our control. But that's for another day. (Mimosa healthcare hang your heads in shame)

I think upping the retirement age all the time based on the average age you are likely to die isn't very scientific, there's a difference between life-span and health-span . I would say we are getting less healthy in old age then people in the past, with the exception of smoking, people eat less healthy, drink more and are more obese in older age groups.
