    I doubt they will put a sick man in prison for a crime like this.

    Pronounced guilty before the defence has had a chance to put its case.

    Is it possible to get a fair trial in such cases with newspaper reporting like this?

    The Mail cant even get his name right so why do we believe anything else in that report

    Also I notice they are reporting the prosecution case - bet they dont cover the defence.

    I do remember one court case I actually knew the full story of and the report in the press of the prosecution (incorrectly) made it seem a clear case of an offence being committed.

    The defence easily convinced the court that they hadnt been told the whole truth by the prosecution and the case was dismissed - this wasnt reported in the media at all

    I have genuinely no idea whether the iSoft directors are guilty or not but I doubt reading the Daily Mail will help me decide

    Its a bit odd that the FSA are saying the external auditors were misled, it would have only taken a phone call to the Irish commissioning group to find out when the contracts were finalised, it allegedly didn't take Deloittes very long to find out ,when iSoft was taken over.

    I think it's going to be hard to prove. The question is intent. And thats intent at the time.

    At the time the auditors probably looked at the revenues and considered them appropriate for the value of the contracts (it is their job to test anything within materilaity relating to cut off of income), in hindsight as the project fell apart it looks more suspicious and with the passage of time, it looks more suspicious.

    The proof will have to show they knowingly accounted for that income and colluded to keep the city and shareholders in the dark and that they knew the accounts weren't accurate and benefitted accordingly.

    I think its fair to say most directors of a PLC would be happy reducing their shareholding for profit at a time when they thought the company was at the top of its game.

    Surely a companies value at any time is based on current wealth - And its future turnover?

    Isnt this what every big company does when its dealing with shares?

    They gained a contract worth a billion pounds, then sold the company to a firm who couldnt fullfill the terms of the previously agreed contract, morally wrong defo, legally wrong, i cant see how they can be guilty.

    The sale of the company came later I think. This relates to selling of shares in the company whilst they were at a high price. The issue is why the price was high and was it high becaus etehy deliberately misled the Stock Exchange.

    Fair enough

    but the report states the prosecution's case as if it were fact and the in the very last line of the article slips the word "alleged" in and mentions in passing that what they said earlier is just the prosecution's case. Proper reporting would START by saying that the prosecution case is.......
