not wishing to be a spoilsport but............. the fixtures are copyright and some sites in the past have been made to remove the fixtures or face closure! The FL are very picky about this issue
not to be pedantic but no they aren't. The football league try to bully sites into thinking that they are but in actual fact they are not.
I thought they were I know there was a bit of a do about this a few years ago but I thought the outcome was that the generating body could not charge for reproduction of fixture lists under the EU Database Rights directive. However, as I understand it, they could, under copyright law, refuse permission to other people or bodies to publish or otherwise distribute the fixtures. It was just the fact they imposed a charge for the licence to do so, that was deemed unlawful. I could be wrong though. I'm getting good at that lately.
I think that you're right with the first bit but my understanding of the second part was that it was ruled (or the law states) that you can only copyright something that you have taken time to create but in the case of football fixtures the actual list has taken no time at all to create, it is purely a list of events. I think a crucial part was something along the lines of they have no idea how I would go about getting a list of fixtures to copy. Did I simply look at one on the official site and copy it word for word? Or did I take time to find out when barnsley are playing each of their games? If it is the latter then I have created the list, not them. The fact that it has the same teams on the same day's is simply down to the fact that obviously that is when an event is taking place. For example, if I phone barnsley up and ask when they are playing ispwich, then do the same for sheffield wednesday, doncaster etc and I write these results of my research down in a list form then I have done nothing wrong. OR I could be talking out of my arse again
The real question is why would they get so uppety about people replicating the fixture lists? What do they think will happen? Fans might start figuring out when certain matches are on and go to them? I can imagine a company wanting to protect everything remotely linked to it but an organisation set up supposedly to look after the good of the game... what have they to fear? Mind you, we all know it's really just a big money making scam. My mate was going to write a World Cup related football game for yahoo! a couple of years ago. The stumbling block? FIFA wanted £50k for using the players names. Gimme gimme gimme. Of course, you'll also find that the Barnsley crest, Lotto logo and Barnsley BS logos are also copyright, as well as their arrangement that consitutes the shirt design so you may as well just go for it. At least they couldn't copyright the colour red... or could they?
Don't make the title Barnsley FC fixtures..... Make it - Date and time when commentary MAY begin on Barnsley world.
