The Football League have responded to the High Court writ issued by the club with an offer of arbitration.
The club issued the writ with regard to the 15-point sanction imposed by the Football League on the eve of the 2007/08 season.
Arbitration would see the matter heard by a panel of three - one representative nominated by Leeds United, one by the Football League, and a neutral appeal court judge.
United chairman Ken Batessaid: "The letter arrived from the League's solicitorsyesterday morning suggesting that this should go to arbitration with a Court of Appeal judge.
"To quote their words, 'impartiality and independence will be guaranteed and the competence of the tribunal will be par excellence'. Impartiality and independence is what we have been arguing for all along.
"It is a long overdue development and the pleasing thing from our point of view is that a Court of Appeal judge will hear it. After a Law Lord, they are the highest in the land.
"We haven't accepted as yet, we are now considering the matter. If we do accept we would want the matter to be open, and if they are satisfied that it has all been done correctly, they would want the world to know that as well.
"But, this matter has to be resolved sooner rather than later for the sake of all the clubs in League One with an interest in promotion.
"What makes me laugh is that it has taken six months to get to this position, six months in which the League have refused to discuss the matter with us.
"The delay has helped no-one. It will be interesting to see Lord Mawhinney being cross examined.
"The decision to deduct us 15 points was purely one born of self-interest on behalf of the other clubs."

I think he'll find............... it was because they breached League rules-open and shut case-don't join the organisation if you don't like the rules
and............... it was only the League allowing "exceptional circumstances"-whatever they were?-that allowed Leeds to compete at all this season
My prediction if the FA are over ruled, Leeds come up and we go down. A number of BBSers are literally going to go postal.
