gutted. they didnt make me redundant or fired, just said no work and acas say i cant do anything. But as soon as i left (they asked me to clear my desk) changed all passwords and asked for my key back. Im cheesed for ok i only earnt 22k but now im on nowt.
Sorry to hear that. Same happened to me a few months ago, fixed term contract - easy and cheap to get rid of. Last day was gutting, handed back my pass & keys, forgot my phone and couldn't go back in the building unaccompanied. After 5 years n'all.
After 4 years continuous fixed term contracts you have the right to claim unfair dismissal mate. Sounds like you're employer may have cocked up.
Why did Acas say you can't do anything? If you have more than 51weeks service or 103 from April 2012 you are able to claim unfair dismissal if they have acted unreasonably? Acas are recruiting a lot at the moment but in my experience not training people properly and giving people very dodgy advice.
Wasn't the case, I had to resign a permanent contract to progress which was my decision. The next one would have been my fourth year of fixed terms, which was well sly by HR. They were reining in a massive staff overspend so could justify it.
It's all about continuous service mate rather than contracts. So long as you don't have a 7 day break in employment you should be ok. It gets pretty complicated but there was a case handed down about a month ago on it.
acas say i cant demand redundancy until 4 weeks of being laid off. im still employed but they dont want me back, like a gardening leave with no pay. is rule sucks big time cant believe the ****ers in charge of the country allow employers to d o this
A week for every year subject to statutory cap which wouldn't apply. Would be entitled to around 860 to 900 pounds if 2 years full completed years.
Right, do theyve actually Laid you off in the legal sense. Did they have a contractual right to do so? Ie a lay off clause in your contract of employment? They need to. Not many employers use proper lay off but they must have a clause allowing them to do it.
its been happening in the building trade for years and years, nobody wanted to fight for the rights of construction workers years ago. And nobody cared So now its happening in other jobs. its a legal loophole, and they can call you back for 1 day and then the 4 weeks extend from that 1 day you work.If you refuse they sack you. If you get another job in the next 4 weeks then you cannot claim anything either. If i was you i would register to claim job seekers asap, explain the situation in your interview. If you dont register with job seekers its very hard to get it back dated.YOU CAN do the initial process online and they will then call you.
Go to direct.gov.uk , type in Lay-offs and short-time working and compare your own situation with their advice.
I have just survived the chop for at least another month. I had a 33% chance of getting the boot. I have now been on a rolling monthly contact for 4.5 years. I have also seen off 5 managers in that time. I must have a charmed life. I'm just gutted for my work mate who has to leave us on the 28th.
Sorry to hear that mate, I'm sure if you knock on enough doors something will turn up, just keep your chin up
