I heard about this a few weeks ago and after listening to both I really thought the decision in court would go the other way.
They were found not guilty because the run of notes is already in the public domain and free to use. It's from an old Italian composer. The prosecuting lawyers tried to settle for 1 dollar and their court costs when the defence presented their evidence. http://youtu.be/zKpbJ5Kjy2I
As a musician... no way is that plagiarism just a descending chromatic scale of 5 notes before the final chord which is different. Just because the accoustic guitar sounds similar there are hundreds of songs with similar chromatic scales.
