We have receive today a PARKING CHARGE NOTICE from SMART PARKING stating that my wife has parked in the ASDA carpark longer than the 2 hours allowed. Appreciated she was there 3 hours and 7 minutes but that is due to a vistit to ASDA and a VISIT to MCDonalds withing that time period. Are these PARKING CHARGE NOTICES legally enforceable? Any legeal eagles help would be appreciated.
I reckon you can ignore it, they will try again, ignore that one and they MAY try again, but they will not go to court, very rare for these to go to court, they get enough people just coughing up.
just write on it NO CONTRACT and return to sender, thats all i did when I got one These *******s make a fortune from people using scare tactics which are totally unenforceable
Mrs is a lawyer, she says totally not enforceable. Just don't reply to it. They only rely on people who do pay. Doesn't matter whether it says invoice on it either.
red army is right,dont reply to it or anything they send,bin it....it'll cost them far too much to take you to court and being a private company they'll make their money out of those that just pay up.
There was a big thing on BBC Watch Dog encouraging people to just bin them and ignore it. Not enforceable was their verdict.
