    Is that typically the size of the settlements?</p>

    How many years did you work underground? Do you have any chest problems? Don't they rate you like, 20percent incapacity).</p>

    We are just going through this for my mother (not that she worked underground, like). She has been offered 3100 (she was given 2kof it years ago). We are in the process of telling them to shove it their arse.</p>

    I heard about theright to claimas my dad was dying from the lungs..... eight years ago. I focussed on it. It just seemed like something that I could do because I sure as hell couldn't do anything about my dad goingout in such a way as that.</p>

    I sort of lookon the insurance company or the Governement or the lawyers as being the bad guys who are at fault because the miners got lung disease. In my head its a bit like the Erin Brockovic movie. Am I out of step with everybody on this?I have the mindset that my dadis worth more than three grand and they can keep it.</p>

    Has anybodyhad any experiencewith these claims?</p>

    not a claim for me, that was for my dad, and he's been dead 30 years

    sure there should be more money for you, my uncle has given me £600 in the last year from my grandads claim, bear in mind im not in the know how much he received, but this money is being split at least 3 ways........................

    Used to work for your "enemy". The people there only work to an agreed handling scheme, agreed with the CSG (Claimant's Solicitors Group) following the test cases for each major disease (COPD and VWF).

    If he died 30 years ago. it's likely that a post mortem offer has been made based upon "balance of probabilities" that COPD did contribute to his death.

    There's all sorts to take into account i.e. time spent underground, time spent in-bye or out-bye, which pit worked at (each pit has its own dust model)

    A female in Chesterfield. We've been passed around.If you were to read her responses you would say that she was working for the other side. Actually, I believe she just wants it off her desk. Shedoes feckall until you send her a letter asking her what is happening. Then she picks up the ball again and then forgets about it until the next letter from me three months later. It is eight years since we started this processbut now have an offer from Capita.</p>

    I wrote a long letter to the lawyer explaining why we were rejecting the offer and please forward the letter to Capita. She wrote a reply saying that it was fair and that the offer was within the guidelines and I seem to be misunderstanding the scope of the scheme. I am just about to write back to her and say, &quot;Thanyou for the time you have taken to write your letter. However will you please forward our letter to Capita&quot;</p>

    In essence though, providing that the offer is within the guidlines of what should be offered, she is correct. Capita have no discretion per se as the claim is not being handled at common law, it is being handled under a handling scheme that dictates what level of damages should be paid at which level of injury.

    Ultimately, ask them to break down the offer, if they have not done so already and explain why you are getting the amount offered.

    If they do this and you are still not satisfied then the next course of action is to ask them to treat it as a complaint, although it's not likely to get you any more money from Capita as long as the offer has been calculated correctly in line with the level of injury

    PM the name of the firm and I'll comment on them....

    My father only got about £500 for his father. He died about 32 years ago though.

    My mother got a payout for my dad,was told by Raleys she could be due for some more because they were waiting for some software on how to work out something to due with his pit pension,this must be six years ago not heard a thing.
