    Now don't get me wrong ...as an ex smoker and someone who never smoked anyway in the car with children present I think the idea of it being illegal is good. Except...
    They should have defined 'children' as under 16 NOT 18. Now we have a situation where a 17 year old driver can smoke on his own or with 18year old passengers but they cannot because there is an under 18 in the car so they are committing an offence. Farcical!

    If its Policed as succesfully as the Mobile phone using drivers are

    then nothing will change .

    You have to be 18 to buy tobacco, but only 16 to smoke in a public place. Think you can be any age to smoke in your house or car. So, if I gave a lift to a 16 year old (or even a 14 year old I believe) and they had a cig, that would be fine. But if I had a cig, I'd be breaking the law. Not that I care, but it is daft.

    Obviously I'm a non-smoker - what's the point in having to be 18 to buy them if some irresponsible adult gives them to kids?

    drivers should be banned from smoking, some daft mare nearly had me this morning, she was smoking, both hands on the wheel , cig stuck in her gob squinting through the smoke!

    That is far more farcical. Take a sip of water while at traffic lights and its illegal but you can smoke while you drive all you want.

    I think it actually says the only under 18 it doesn't apply to is if it is the driver.

    So a 17 yo driving can smoke as long as the other passengers are 18 or over

    But my point is he can and THEY can't as he is under 18 so they are committing an offence if they smoke but he isn't

    Imagine the uproar if those who want people banned from smoking in their own homes get their own way. Basically wanting homes to have a metre put in and every so often someone (like with water reading) goes around houses and checks the reading for any sign nicotine.
