I’m not sure the panel have those Powers tbh. Same as EFL can’t be responsible for running of clubs or it’s internal affairs . Only powers EFL have is if they break the rules set out and they have by going into admin . I don’t think they can rule that the internal affairs are force majeure otherwise it opens a Pandora’s box with any club and any reasons to overturn its rules . The one and only factor and I know I’m repeating myself is have Wigan gone into administration invoking the EFLs rules and if so were the penalty’s properly imposed . That’s the only stumbling block with me is have the EFL dotted all the Is and crossed all the Ts? The internal affairs are not force majeure unless the owner was suddenly deceased and nothing was in place to carry on but even then it’s flimsy . If it’s true that the administrator or whoever have a six thousand page document I’m more comfortable with that imo they’re clutching at straws. If however they are simply looking at how the punishment was administered then I’d be more worried because they’re not looking at If they should be punished but how they’ve been served the punishment .
I think you might be right there. From what I can grasp they're quite fine about the deduction they just don't want to be relegated.
If we’re shafted then we have a litigation but there’s implications with that . Just hope the EFL have gone through the proper procedure and if they have well be fine imo .
Wow. Just made the mistake of reading the Wigan forum. There's so much misinformation and plain untruths on there about Barnsley it's unreal. I hope their legal team are as equally badly prepared!! They've whipped themselves into a frothing rage about us, when their ire should be directed elsewhere. It's patently obvious that they're a club that's overspent - not as bad as some, obviously, but still guilty as charged - yet there's not a single poster on there that can see it. Heads well & truly in sand on that one
But then there’s no punishment, there’s a lot against them tbh and if as I say proper procedure has taken place they’re down end of .
That view has been expressed by others but the punishment is the points reduction. Relegation in this instance is coincidental. If Wigan had grabbed a late winner against Fulham we wouldn’t be having this debate
That's a point I haven't seen mentioned before. Wigan knew about this situation in plenty of time to fight their way out of it on the pitch, just as we did. And they had the advantages of better form and a vastly superior goal difference to their rivals.
Wigan journo tweeted that he's spoken to their QC. Looks like no decision Friday, but likely to be reached over the weekend...
I think the EFL said about 3 days after playoffs finish they have a meeting to confirm teams and leagues for next season. Something like 7th August
Even if it is a force majeure event (and it isn't), the administration is by no means solely due to that, as combined losses of £16 million in previous seasons show. Got to say, that 12 point statement pissed me off, particularly the claim that they didn't go into admin to get a competitive advantage. They don't realise that they already had the competitive advantage, and now the money has run out.
Lost on Wigan and it’s fans that. All because that kid didn’t get sold to Italy because of him failing a medical is the usual response. They don’t seem to understand paying 3 times the wages we do on lesser crowds etc.
They bought our top scorer in the summer with money they didn't have and now the debt tap's been turned off it's apparently us that are the tw*ts and them that deserve to stay up.
Hang about. They've not put together a 6000 page defence in 8 days, that would be 750 pages a day! Even if they started work on it the day they entered administration, 1 July, that's 30 days, or 200 pages a day. Still sounds impossible to me. So, if it's true (and not just a positive sounding piece of fake news), then someone was working on it long before they entered administration. In which case, they knew full well that the 12 points deduction was coming. Which in turn means that they knew they were breaking the rules. I rest my case, Your Honour. Now put your black cap on and send the ******** down.
Looking back at the tweets it's some fans that have been working night and day scouring the Internet for evidence of malpractice by the owners and has been passed to the QC. Probably 5950 pages of repeated nonsense and 50 pages by the QC
