This makes absolute sense to me. If they have proved Force Majeure, then logically there can be no penalty incurred. If they have failed to do so, the full penalty stands in line with EFL rules. I cannot see how a reduction of the points penalty, or deferral to next season, is involved. If they have indeed proved Force Majeure, then the reasoning would surely have to be cast iron. Personally, I’ll be relieved when we know one way or the other. I’ve found this way more stressful than if we’d just been relegated in the first place. Whatever happens, the EFL must ensure this can never happen again - simply too unfair to everyone involved (except the lawyers of course).
Is this Kendrick guy one of the admin? If so why is he leaking this out? Did they know the outcome on friday but were asked to keep shtum? Have we known the outcome but agreed to keep shtum? Is that why a certain poster was so confident?

Realistically - this is why the appeal is unlikely to succeed. If they had a new owner and a good chance to start next season in a reasonable state, they'd have got a 10 point deduction. But why would the EFL gamble on keeping a side in the championship that has every chance of not being able to finish the season? Wigan have an unstable financial history, a very dodgy financial present and an unknown financial future - it'd be beyond stupid to give them a chance to stay in the championship.
Nah - the EFL have only one vested interest, and that's their own reputation. They'll look like idiots if they relegate Barnsley and then Wigan can't start the season - and there's every chance that'll happen.
I don't think they care about their reputation, all they care about is their bank balance. They will punish clubs based on how much money that club is worth to them
Once sheff wed have received there punishment and reasons in writing they have 14 days to appeal verdict of disciplinary panels decision. Should Wigan lose out will they have the same rights??
Various comments on here today such as 'the EFL appeals panel', 'why would the EFL gamble...' etc etc. The panel that heard the appeal are independent and nothing to do with the EFL. The EFL issued the 12 point deduction. If it's cancelled, it's nothing to do with the EFL.
No, this decision is binding on Wigan and Barnsley. All Barnsley can do is to then take legal action and ultimately try and claim some compensation for the financial loss. If Wigan lose the appeal, I don't think they can do anything further.
I don't think there's much chance of compensation being paid. The EFL's decision was to apply the full penalty now. We have presumably signed up to abide by the independent appeal panel's verdict. The panel will make a decision that is within their powers, so I can't see that any compensation claim will succeed.
Nah, the independent disciplinary panel made the first decision in this case. So their decision can be appealed. Wigan's/our's is the appeal hearing from the EFL determination.
It is an automatic 12 point deduction for going into administration, there is no discretion involved.
i can see a serious case for compensation, i can also see a raft of clubs taking the admin option if they know they wont get relegated.
