His criminal record is absolutely appalling. It's about time he grew up and finally accepted full responsibility for his violent conduct.
Thanks Donny Red. My guess is that JB if given the opportunity will plead guilty to a lesser charge and will get a non-custodial sentence. The one with the bigger problem is the Leeds guy. The whole joint enterprise issue has been challenged but doesn't seem to have changed - last year 11 guys were found guilty of a single murder. If he's part of a gang and one member of that gang commits an offence he can be included and found guilty although he may have done nothing or indeed he may not even have been there. Last year some guys serving a prison sentence were found guilty of an offence which took place in a town centre because they had contact with the perpetrators. (think I posted a similar message on the earlier JB thread)
Barton is to appear at Barnsley Magistrates Court next Wednesday 9th October, to face a charge of causing actual bodily harm following the incident involving Daniel Stendel on April 13th 2019 after the Reds had beaten Barton's Fleetwood Town 4-2.
That will be fun. The national press will be there for it and probably a fair few tarn fans to tell him what they think of him.
As far as I understand these will be brought up after the trial, when it comes to sentencing. If found guilty, surely he will get time.
Let's hope you're right JP. Surely the time has come to make the bloke take stock and impress upon him once and for all, that he cannot persistently use violence and must finally be held accountable for his future actions by imposing a custodial sentence.
No doubt he will claim it was a push and the subsequent impact with the railing/post whatever was an unforeseen result of the push. That said I am sure the original reports stated the charge referenced 'racially aggravated' assault. Given Barton's.... ahem... exemplary record as a fine upstanding law abiding citizen and who is a perfect role model for young people (Guffaw), the following sentences makes for interesting reading. "ABH carries a maximum sentence of five years and or a fine (depending on the seriousness of the offence). For a first offence, a fine and or community order may be imposed. If the offender has previous convictions or if there are aggravating factors, a prison sentence is more likely." Given his history. should he be found guilty, then anything other than a custodial sentence would surely cause a few eyebrows to be raised.
Assault occasioning ABH is triable either way which means it can be heard in Magistrates or the Crown Court. A defendant can ask for jury trial or the magistrates can send it to the Crown if they feel it is too complex or that their sentencing powers are insufficient (wouldnt think these really apply here) so it would be up to Barton. BTW max sentence for ABH is five years not three as someone else posted somehere on this thread but such a sentence is extremely unlikely
I'm not a lawyer but if the magistrates think this is a sufficiently serious offence, can they move it up to the Crown Court as an indictable offence ?
I know Barton is a dick but I'm not comfortable with us acting as judge and jury. The bloke is a total ***** agreed. I'm not sure he deserves to go to prison for this. The punishment wouldn't fit the crime .
His previous record plus if found guilty this time throws him in jail. It's not a case of an over-zealous punishment it's a case of a repeat offender getting what he deserves (if found guilty)
This isnt the first time though is it? And if Daniel required dental surgery it was more than handbags.
