Thing is Zero hours contracts do have their uses. For example my wife has one for her hobby job as a ski instructor at the local artificial slope. If she is free when they are looking for an instructor to take a lesson she goes in, if she isnt they go and ask one of the other instructors. They do have some full time staff but most of the evening and weekend instuction is by "volunteer" instructors on zero hours contracts. Thats how they should be used. Where its a problem is when a zero hours contact has an obligation that someone must be available at particular times but there is no guarantee of work. If you want someone to be available you should have to pay them - simple
The abuse has come with the loss of holiday pay due to the zero hour contracts. Also if there is no work for you they are not obliged to give you any although you have to jump when they tell you to. Add to that the nightmare of trying to get money from the social when you are not working, pray you never have to go through that.
Exactly. My husband (not in a zero hours contract job) has just had to go on an out of hours support rota as a colleague is leaving. He may be called upon, he may not, but it pays a flat rate per evening/night whether he is needed or not with a £30 an hour rate on top if he is called. You can't just expect someone to sit around all day at your potential beck and call for free.
Is he in a Union? His employer may be making themselves vulnerable to claims under NMW legislation. Many care homes are having to pay back pay for up to 6 years as a result of similar practices.
No, he's not. As I say though, they are paying him a flat rate for being available, plus the extra pay if he is called upon. This is on top of his annual full time salary (not sure I made that clear). My point was just to back up Farnham - that you should be paid for any time you make yourself available.
I no longer qualify to do on-call (different business unit now), but i've always had a rate to have the phone on and extra for actual work. This is on top of salary. On call can be a great boost to the pay but it can play havoc with the sleep patterns. My record was over 100 hours out-of-hours in a month.
Yeah, I don't think he's looking forward to it. Luckily, it's just 1 week a month as no-one wanted to do it so it's been split between the 4 developers. The guy who used to do it didn't get many calls, it's just annoying having to be near the computer incase one comes in.
I just needed to be near a wi-fi connection. Away from home, pubs, McDonalds and coffee shops are great places to jump online to fix an issue. All I had to do was have the laptop in the car and my phone in my pocket.
Or of course there could just be a clause in the contract to allow a 48 hour opt out.....which exists in most employment contracts. Any who wants to work more than 48 hours anyway!!! I’ve never read such a pile of *****
